‘Attack him and be done with’, I have already given the order: another white Van criminal operation under regime chief


(Lanka-e-. News -14Jan.2012, 6.30PM) On the 10th, Lanka e news exposed the white Van operators under the caption ‘Operators of the white van new criminal dimension and culture exposed’. Following this exposure, Lanka e news is in receipt of copious evidence and information that this white Van criminal operations are being conducted by the regime chief . We give hereunder an incident which amply testifies to this truth.

Vasantha Senanayake is a representative of the Mirigama electorate for Parliament currently. He is a popular descendent of the D S Senanayake lineage who entered Parliament in the SLFP ticket for the first time. He is a Lawyer who is not in practice. He is a businessman. A playful youth. He is a frivolous globe trotter , and who attends Parliament once in a blue moon. When the regime chief inquired from him as to his conduct , Senanayake had told him he is mostly abroad because a business rival of his , Neil is lying in wait to kill him.

The brutal regime chief had then said , my MPs cannot be in fear like that , and ordered the white van criminals to attack the businessman Neil. ‘Gahala dhanawa’ (attack and be done with ), was his order . When Chandiyas ( thugs and gangsters), soldiers order ‘attack him’ ,it means shoot and kill him. Now the brutal regime chief’s language follows that same pattern ‘attack him’. In other words what he meant was to kill Neil.

Neil is a businessman from Katana. His main business is purchasing ‘rejects’ of clothes from the Free trade zone factories and selling them in the market. He has been engaged in this business for a long while. His other business was importing vehicles from abroad and selling them. He owns a number of car sales points. He was a long time supporter of late Jeyaraj Fernandopulle. He was a SLFP er himself.

When he heard of the criminal order of the regime chief , he began hiding in fear. Neil had told the SLFP Ministers and MPs who had obtained political support from him to help him out of the crisis.

As a sequel to his request, Faiz Musthafa, Sarath Gunaratne, and Sudarhsani Fernandopulle (widow of Jeyaraj) along with other MPS and Ministers have met MaRa, the regime chief. When they began explaining that Neil is a supporter of theirs , and he had been supporting Jaeyraj Fernandopulle even when he was living , the regime chief had furiously retorted,’ No, No, he is waiting to kill an M P. I have already given the order to liquidate him’ . Those who went to meet him were shocked at MaRa’s outrageous conduct – they could not believe their eyes and ears when they heard and saw a Democratically elected leader of a country talking openly of giving orders to liquidate his own people – reminiscent of Hitler’s orders during the Nazi rule.
Neil had been hiding for a month since, while the Van had been combing the Matara district in search of him where his relatives live. He is in such a mortal fear that he is frightened to go even to the Airport to bolt out of the country. He has no faith at all in anyone , not to mention the police. His only option available to him now is to disclose his predicament to Lanka e news which fearlessly , frankly and forthrightly exposes the truth, and reveal to the whole world his dire plight , he states. We are only acting in compliance with his pathetic request as he is now in a country where jungle laws prevail with brutes , buffalos , wolves , hyenas and serpents ruling the roost.

Lamentably , this is the dangerous situation in this country .
Lawlessness is enthroned with law abiding citizens having nowhere to go to get redress to their woes . When the chief who sits on that throne is lawlessness personified , those around him too are infected with that deadly contagion. Incidentally , the Kelaniya local body members are still not having a peaceful sleep with threat of death and abduction stalking them every moment of the day. They are still sleeping in abodes providing them security .

If the SLFP members who are law abiding and civilized do not take action to combat this dire and deadly environment . The next tragic drama they may well have to witness will be, an order ,‘attack him’ from the chief MaRa directed against Maithri, Nimal or Berty . When that order actually comes it will be too late for the SLFP ers to counter MaRa's killing strategies. Perhaps, by that time they may not live to tell the tale any longer, let alone complain.

(Lanka-e-News-06.March.2012, 11.55PM) The UN active group had in its report presented to the Geneva Human rights Commission on forced abductions had stated that no measures had been taken so far in respect of the 5761 abductions committed in SL.

A most significant feature is , in the statistics provided in the report , the many tens of thousands of disappearances during the final phase of the war had not been included . If a complaint is to be made to this active group Committee , somebody close to the victim of disappearance should inform. Unfortunately , there aren’t even such persons remaining after the war to inform of the disappearances. Even without including those large number of disappearances , the number of disappearances standing at 5761 is something specially noteworthy.

In the report , charges are leveled that impartial inquiries in regard to the human rights violators , filing charges, trying them in a court of law and punishing them had not been duly done . Neither the SL police nor the human rights Commission had been able to mete out justice to the victims, the report adds. Though various Commissions had been appointed , none of them had any vision and the people had no adequate opportunity to present their facts, the report laments.

The UN groups in its report further states that the SL Govt. did not answer the charges , and it did not respond to the many requests made to it in 2009, 2010 and 2011 by the Active Committee to give it an opportunity to come to SL and investigate the facts.

The abductions carried out in the white Van by the Rajapakse regime and disappearances of victims had been portrayed to the people as a lawful process. This Rajapakse regime has become a byword for murder and has become so criminal that it has gone so far as to outrageously abduct in the white Van in broad daylight , a suspect who is being taken back to prison after being brought to courts while he was still in the court precincts.

(Lanka-e-News-05.Feb.2012,11.45PM) A leader in Jaffna of EPDP party of Minister Douglas Devananda had raped and killed a 13 year old girl, according to reports reaching Lanka e news. Kandasamy Jegadeeswaran, this ruthless rapist and murderer holds a high post in the armed group of the EPDP.

The victim, a school girl residing at Nedunthivu , Jaffna had gone to the boutique to buy bread after returning from School on 3rd of March last saturday. The criminal had arrived in a bicycle and offered a lift to the girl as the boutique is far from home. As the rapist murderer was known to the family , she had accepted the lift. Later, he had taken her to a desolate place and raped her before killing her by hitting with a pole to her head.

After the body of the girl was discovered on yesterday(04), and the village came to know of it, they have attacked the criminal and handed him over to the police. In an earlier incident this same criminal belonging to Minister Douglas Devananda’s party has raped a lady after threatening her by brandishing a pistol. But she had not informed anybody out of fear.
The civilians resident in Jaffna accuse Minister Devananda and hold him directly responsible for the raging crimes including rapes, abductions and murders in the north. The irony of it is this same allegedly criminal Minister is a member of SL Govt. ‘s team of representative s presently attending the sessions of the human rights Commission in Geneva.

Human rights Commissioner resigns in disgust: says unable to work following his conscience

(Lanka-e-News-01.Jan.2012, 11.45PM) M A J Mendis , the Commissioner of Sri Lanka human rights Commission had decided to resign his post. He said that he had arrived at this decision not based on instantaneous causes nor prompted by personal reasons. Since he took up this appointment last February , he had been deliberating on this , he added. As he cannot work in accord with his conscience and is unable to be steadfast in his policies , he had tendered his resignation letter to the President , and that the latter had accepted it, Mendis noted.

However , Mr. Mendis did not elaborate on his statement that he is unable to work following his conscience.

As is extremely rare in the present political context to pick out a Govt. servant in SL particularly in the higher echelons working in conformity with his/ her conscience , so Mendis’ sentiment expressed frankly, fearlessly and forthrightly while being a Govt. servant shall be appreciated by one and all. If there are more like him in the Govt. service there would be fewer cowards and corrupt elements who are adding fuel to the fire of raging evils of the rulers in this country via their cowardice and their own corruption.

Lawyers Urge the Government of Sri Lanka to Respect the Right to Peaceful Assembly

(Lanka-e-News-26.Jan.2012, 9.30PM) The Lawyers for Democracy (LfD) condemns the tactics used by the Government and its agents to disregard the fundamental right of a citizen to conduct peaceful protests in Sri Lanka, and the use of deplorable strong armed tactics to prevent a lawful protest rally organized by media groups yesterday (25th January 2012) titled ‘Black January’to be originally held at the Fort Railway station, Colombo.

The protest rally was organized by several media groups to highlight the challenging conditions faced by media actors in Sri Lanka and to mark the death and disappearances of several colleagues who were either killed or disappeared in the month of January. In light of such a protest rally, several measures were taken by the Government and its agents to thwart the right to dissent. LfD was informed that the police had attempted to obtain a court order to prevent the lawful demonstration. Media reported that government backed protestors were transported at the instance of government to the vicinity of the Fort Railway station, close to the time when the media demonstration was to commence. In light of the security threats, the media groups had to change the location of the protest rally with short notice.

LfD reiterate that the Constitution of Sri Lanka guarantees the freedom of peaceful assembly. All public organs of the state including the police and judiciary are expected to respect, secure and advance the fundamental rights guaranteed to its citizens. LfD is seriously concerned about the recent development where the police is seeking ex parte judicial orders to curtail peaceful meetings, all of which are clear political expressions against the government. We are also unable to apprehend the legal provisions that authorise the police to obtain judicial orders in these instances. The Supreme Court has time and again recognizedthat the “right to support or criticize the government is fundamental to the democratic way of life, which cannot be denied without violating those fundamental principles of liberty and justice, which lies at the base of all civil and political institutions”. We are also seriously concerned with the tactics used including the use of government back armed actors to disturb peaceful rallies and demonstrations. The impunity with which these groups operate is alarming. For example, today’s events were witnessed by the police who stood by and did nothing to prevent the goons from arriving to disrupt a planned protest rally. Such incidents are indicators of the breakdown of law and order and the threat to the democratic culture in Sri Lanka. We urge the Government of Sri Lanka to respect its constitutional obligations andcommitment to respect freedom of expression and peaceful assembly and prevent the repeat of such events in the future.

President relates gleefully how he took India for a ride: 'There is no 13 plus I know of' he says

(Lanka-e-News-01.Jan.2012, 11.45PM) President Mahinda Rajapakse who promised to the Indian foreign Minister Krishnan on the 17th January that he would provide a 13 plus solution to the Sri Lanka East –North issue had announced the very following day that he took India for a ride.

The President had given this as an answer to questions posed by the Ministers about Krishnan’s statement ,when he attended the function on 18th on the occasion of the Birthday of Minister Anura Priyadharshana Yapa.

‘There is no 13 plus that I know of. That is to take them for a ride. A Dharusman report was brought forward . I dragged that for about two years , and then introduced to the LLRC.. Now where is Dharusman? Thirteen plus will also meet with the same fate. They can be taken for a ride over and over again this way for another two years on the thirteen plus.’. The President had made these remarks with a loud hearty laugh at the function.

One of the Ministers who was present on the occasion had whispered to another Minister ‘ By trying to apply the Medamulana theories in relation to the world , he is some day going to court a disaster much worse than that of Gaddafi.

Minister Samarasinghe deliberately misleads international community :Here is the evidence


(Lanka-e-News-01,March.2012, 5.30PM) It is learnt that Minister Mahinda Samarasinghe who addressed the Geneva Human rights conference on the 27th has premeditatedly and deliberately deluded the international community .

The Minister had in his address at the conference on the 27th stated , the LLRC Commission which was appointed by the President has acknowledged that during the war , the Army had committed unlawful acts , and a court of inquiry is to be appointed by the Army to make preliminary investigations ; and another inquiry is to be held by the Navy.

These statements are deliberately aimed at misleading the international community.

The Army ought to have appointed the court on the 26th of February. That is three months after the LLRC report was published , and just ten days prior to the Geneva conference. It is very clear to anyone that Samarasinghe ‘s statement is a calculated attempt to escape from the grave embarrassment the country is plunged into.

What we are herein revealing is a more grave and serious issue ……..

It is Major General A W J Krishantha De Silva the present Kilinochchi Commanding chief who is appointed as the chief or the President of the military court of inquiry to conduct preliminary inquiries. He was during the final phase of the Wanni war, in charge of the Forward Maintenance Area operations under the present Army Commander Jagath Jayasooriya. At that time De Silva was a Brigadier.

During a war ,in addition to food , medicines, weapons and vehicles which come under the officer in charge of the Forward Maintenance Area , the military police too comes under him. Hence , those enemies who surrender during the war and arrested come under the responsibility of the officer in charge of the Forward Maintenance Area.

One of the charges mounted against the Army in the last war is the killing of LTTE cadres who surrendered as well as those who were arrested.
During that final phase of the war , the Army Commander at that time , Gen. Sarath Fonseka was on a brief visit to China. Accusations have been leveled against the defense Secretary Gotabaya Rajapakse for issuing unlawful orders during that period. One such person to whom Gotabaya gave unlawful instructions was Jagath Jayasooriya who was the Commanding chief of Wanni at that time. Jayasooriya transferred this directive to Brigadier Chrishantha De Silva who was the officer in charge of the Forward Maintenance Area . The officer who is the central figure in the criminal issues which have cropped up today is De Silva.


Now , to investigate whether such crimes did occur has been entrusted to Major Gen. A W J Chrishantha De Silva who was a Brigadier at that time responsible and answerable to those occurrences. The Wanni Commanding chief at that time who gave orders to him was Jagatha Jayasooriya , the present Army Commander.

This scenario is therefore worse than a crime scene where the mother of the criminal is being asked whether her son committed the crime – in this instance, it is the criminal himself being asked to investigate the crime .

Moreover , this Chrishantha De Silva was a so called ‘war hero’ who during the Jayasikuru operations deserted his soldiers and weapons , and fled for dear life (reminiscent of Gota’s fleeing) . At the preliminary inquiries conducted by the Army court of inquiry during that period , he was declared as ‘ a panic officer who goes ‘mad’ without assessing the war situation duly’. For this very reason , the great war hero General Sarath Fonseka who could evaluate his subordinates accurately and won the war for the country did not give De Silva any responsible duties during the final war operations. De Silva was only entrusted with logistic tasks. From what has come to light now , it is clearly confirmed further he had muddled up that sphere of duties too.

No matter what , our Minister Mahinda Samarasinghe of the moronic regime has made a ‘power loaded’ speech at the Geneva conference about a grandiose impending investigation only depending on these deplorable characters , facts and factors. In other words , the representative of the regime chief following in the footsteps of his ‘ boss’ (who is cheating the countrymen wholesale) , has calculatedly and deliberately sought to deceive the international community. But , may they be warned that by trying to cheat the world , they may be cheating themselves, for, some day the truth will declare itself. Sadly for the country , it might be too late when this truism dawns on these schemers and deceivers.

This picture herein reveals how the acting and deputy Minister of external affairs and his supporters burnt the effigy of US President Barak Obama on the 27th of February when staging protests.

His crude and barbaric behavior also clearly portrays how dishonorably he carries out his onerous responsible ‘honorable’ Ministerial duties in relation to external affairs . There is a cultured procedure and behavior that shall be followed by a Minister of a country when staging opposition to a country with whom diplomatic relations are maintained. Nowhere in the world has a responsible Minister of any country in the world ever gave such a perfect piece of rowdy display like our (Dis)honorable Minister . Only in SL , this kind of uncivilized Ministers thrive . This is because jungle laws prevail in SL ,since a brute is the chief.

Civil Organizations burning an effigy in protest is one thing , but a so called Honorable Minister of a Govt. himself leading the protest and burning it with his own hands is an entirely different matter , and is a most grave issue bordering on diplomacy of the barbarians.

It is the view among the high echelons of Diplomatic circles that this conduct of the Minister and the ugly episode is going to seriously militate against SL’s foreign affairs and does not augur well for SL’ s future internationally.

US makes no mention of recommendations relating to SL in its address: Devananda threatens legal action against LLRC

(Lanka-e-News-02.March.2012, 11.45PM) Many Sri Lankans were anxiously waiting to learn what the US was going to say at the on going Geneva conference. The US Deputy additional Secretary Mario Otero who arrived in SL earlier to inform the SL State leaders of the US recommendations that are to be presented, addressed the conference today.

In her address she did not make any mention of the recommendations that are to be presented against SL. All what she told was , the time granted to SL to file answers to the human rights issues is gradually running out. The international community is in anticipation of SL’s answers pertaining to the human rights violations for a long time , she added.

While thanking the SL Govt. for publishing the Lessons learnt and reconciliation Commission (LLRC), she focused on the importance of implementing the recommendations contained therein.

Meanwhile, at the parallel meeting conducted by the SL Govt. at the Geneva Human rights Council , yesterday , the Minister Samarasinghe was stunned to silence by a question posed by V . Kirubakaran of the Tamil human rights wing . The question asked by Kirubaran was :
‘I say clearly that the recommendation s of the LLRC will not be implemented by you.. If you have that report, please turn to page 28 of it. Douglas Devananda who is a respondent in respect of these charges is now on your side as a speaker. In the circumstances, are you telling us to believe that you are going to implement the recommendations?

Samarasinghe whose face reddened with guilt was nonplussed and dumbfounded . Minister Devananda who tried to answer was met by severe protests from the participants.

The enraged Devananda retorted that he is going to file action against the LLRC.

Everyone who had gathered were shocked and baffled.

How the SC decisions in SL are ‘fixed’ by filthy lucre exposed: One 'Broker' is an Astrologer

(Lanka-e-News-07.Feb.2012, 11.45PM) It has come to light that the Supreme court (SC), that is , the highest court in Sri Lanka is also not immune from corruption, and its decisions can be changed via filthy lucre. Lanka e News is in receipt of information pertaining to one of the methods adopted in this sordid manipulation.

The chief justice (CJ) of the SL supreme court is Dr. Shiranee Bandaranaike. Her husband is Pradeep Kariyawasam who was a spare parts vendor of United Motors for some time. Being a marketing manager, he later became the General Manager of United Motors. Subsequently when he became a bosom pal of President he was appointed as the Chairman of Insurance corporation. Currently, he is the Chairman of the National Savings Bank. He holds the rare and ignominious distinction as the only chairman of a Bank who hasn’t any knowledge of finance or Banking management.

Mind you the most ludicrous aspect in these appointments is, that an astrologer is also holding the post of Working Director in that recognized Banking Institution. The whole world must be enjoying this joke when they learnt that it is a bogus astrological calculation wizard and not a financial wizard who is holding a Director post in a premier Bank in SL. This astrological wizard is Sumanadasa Abeygunawardena born in Morawaka and who has obtained his education at Morawaka Maha Vidyalaya. The only qualification (or rather disqualification) he has is that he is the astrologer who reads the astrological charts of the regime chief , Mahinda Rajapakse.

This bogus astrological wizard, the working Director of the Bank and the Chairman of the Bank are extremely close friends .

Now let us revert to our first paragraph of our news :

Sumanadasa Abeygunawardena charges exorbitant fees . May be because he reads the charts of the ‘Maharaja’. The lady who related this sordid episode has also gone to this astrologer to read her chart (kendaraya). She had been made to understand that she can know how to extricate herself from her litigation involvement via the chart reading. After the fees demanded by Abeygunawardena had been paid , the latter had stated that like how he can read where the stars are in the chart , he can also change the position of the stars. In other words he had told that he is capable of changing the decision of the Supreme court if payments are duly made.

The astrologer Sumanadasa Abeygunawardena had told directly and categorically that if she would make the payment demanded, he could ‘fix’ even the SC decision.

This is how it was exposed that the CJ takes bribes through an agent of her husband. They are of course not frightened. After all the bribe is being taken by the CJ herself and the agent is none other than the astrologer for the regime chief. Hence, they must be therefore thinking , under such circumstances when the bigwigs of the judiciary and the Executive are involved , why fear .

When the legal climate and the judiciary has descended this low, it is clear that in SL now, though there is a supreme court there are no supreme legal traits and traditions which characterized it earlier.
Although it is well and widely known unequivocally that the independence of the SC no longer exists. This truth was further confirmed to the whole wide world by SC justices Dr. Shiranee Bandaranaike, Nimal Gamini Amaratunge and Suresh Chandra , when on the day the regime chief’s son took oaths , these justices instead of being on the bench of the SC or in their official chambers , were in their official cloaks joking and shaking hands with the raw lawyer and tumbling over each other to take photographs with him , and attending parties on that occasion. That is, their conduct was not like that of judges of the highest court of SL, but rather like clowns in a circus arena. This scenario was deplorably unique because it had no parallel anywhere in the world in the judicial sphere for its stupidity and absurdity pertaining to behavior of judges of the highest court of the land. Every nook and cranny in the world became aware how like crooks and nannies these judges behaved in Sri Lanka .

It is well for every law abiding citizen of this country to realize that the time has come for them to put their foot down and take a momentous decision against the present SL climate when judicial decision s of the SC can also be changed via bribes.

Can GOSL Implement LLRC Recommendations? By JC Weliamuna (Eisenhower Fellow, Senior Ashoka Fellow & Constitutional Lawyer)

This is the question of the day. This is raised nationally and internationally and answers contrast for different reasons. In this article, I endeavor to briefly answer this question from a governance perspective, keeping in mind the present socio-political realities in Sri Lanka.

The President appointed the Commission of Inquiry on Lessons Learnt and Reconciliations (LLRC) on 15th May 2010 with a broad mandate to inquire into and report on specific matters, in terms of the Commissions of Inquiry Act. The title of the Commission and the mandate in general suggests that the objective of the appointment of the LLRC is to find ways for reconciliation among all communities, after a bloody ethnic conflict. It is also possible to argue that the LLRC was appointed to advise the Head of the State on how to avoid a national tragedy in the future. The Warrant has, among others the following term of reference:

“[inquire and report on] Institutional, administrative and legislative measures which need to be taken in order to prevent any recurrence of such concerns in the future, and to promote further national unity and reconciliation among all communities, and to make any such other recommendation which reference to any of the matters that have been inquired into under the terms of this Warrant.”

In that context, the LLRC had a mandate to examine the governance structures and its functioning to ascertain why Sri Lanka was in a “mess” in relation to ethnic harmony. The LLRC submitted its report on 15th November 2011 to the President and unlike many other Presidential Commission reports, this report is in the public domain.

Governance Related Recommendations

The Report deals with a variety of issues including the Ceasefire Agreement, Overview of Security Operations, Land Issues, Resettlement, and Reconciliation. Judging from its recommendations, we can conclude that the LLRC has also addressed its mind to the relevance of governance for overall reconciliation efforts. Perhaps there may be disagreements on other findings and recommendation, but, I believe, there is implicit consensus on the findings and recommendations on governance aspects. Being a governance and human rights activist, I was delighted to read these specific findings/recommendations. The civil society has been urging the Government of Sri Lanka (GOSL) for many years, to respect the existing constitutional guarantees and establish Rule of Law; and raised almost identical issues. The government continues to pronounce that Sri Lanka has good laws, which are respected. The GOSL never accepted that there was any paucity or deficiency in rule of law or human rights protections. Centuries ago, Aristotle taught us “Good laws, if they are not obeyed, do not constitute good government”.

For the purpose of this article let me reproduce few governance related recommendations of the LLRC, selected and clustered by me for easy reference:

1. Media freedom, attacks on journalists etc.

(a) The LLRC was deeply disturbed by persistent reports concerning attacks on journalists and media institutions and killing of journalists and the fact that these incidents remains to be conclusively investigated and perpetrators brought to justice…. Any failure to investigate and prosecute offenders would undermine the process of reconciliation and the Rule of Law. (paragraph 9.114)
(b) It is essential that media freedom be enhanced in keeping with democratic principles and relevant obligations. Steps should be taken to prevent harassment and attacks on journalists and media institutions and deterrent punishment should be imposed on those who were responsible for attacks. Priority should also be given to the “investigation, prosecution and disposal of such cases to build up public confidence in the criminal justice system”. (paragraph 9.115)
(c) Government should ensure that the freedom of movement of media personnel in the North and East, as it would help in the exchange of information contributing to the process of reconciliation.
(d) Legislation should be enacted to ensure the right to information (paragraph 9.115) 2. Freedom of Association

People, community leaders and religious leaders should be free to organize peaceful events and meetings without restrictions. (paragraph 9.118)

3. Law Enforcement, Police and Impunity
---------------------------------------------
(a) The Commission notes the failure on the part of the law enforcement officers to investigate offences and bring offenders to book, where the offences are committed by persons with political connections. The Commission emphasizes that all allegations should be investigated and wrongdoers prosecuted and punished irrespective of their political links, so as to inspire confidence among the people in the administration of justice (paragraph 9.203 & 212)
(b) The Police Department is a civilian institution which is entrusted with the maintenance of Law and Order. Therefore, it is desirable that the Police Department be de-linked from the institutions dealing with the armed forces which are responsible for the security of the State. (paragraph 9.214)
(c) An independent permanent Police Commission is a pre-requisite to guarantee the effective function of the Police and to generate public confidence. (paragraph 9.215)
(d) Activities of illegal armed groups are of serious concern to the Commission. It appeared that the dominating presence and activities of such groups have created fear among the general public, contributing to an environment of impunity. Some of their illegal activities affected the basic rights of people such as the right to life. …. Action should be taken to disarm and put an end to illegal activities of these groups (paragraph 9.72-74)

The above recommendations are self-explanatory and need no elaboration. It speaks volumes of the present governance status. The LLRC was able to find the nexus between Rule of Law and Reconciliation. It has found that the collapse of Rule of Law and restrictions on civil liberties is detrimental to reconciliation efforts.

Priority to Tighten the Political Grip;

Probably one can argue that the whole issue of accountability (in the final stage of the war) has been ignored by the LLRC. Nevertheless, the local and international community is awaiting the response of the President, not mere GOSL, on the key findings and recommendations of LLRC. In my view, whether the government has the political will to fully implement the LLRC recommendations depends mostly, if not mainly, on whether the President and his government are prepared to respect Rule of Law. Are they genuinely prepared?

This question cannot be answered in a vacuum without understanding the basic norms of how the country is run today. Some of the most significant features of the present GOSL under the leadership of President Rajapaksha is as follows:

(a) The concentration of power within his close circle (family and few others)
(b) Tightening the political grip through control of free expression, media and free assembly, while taking all possible steps to monopolize information.
(c) Politicization and weakening of public institutions including the law enforcement agencies
(d) Militarization of civil life and civilian institutions.
(e) The manipulation of elections, through unprecedented abuse of state resources and emasculation of opposition.

Aspects (a) to (d) above have been dealt with by the LLRC but not the (e) above. Probably there were no sufficient representations made to the LLRC on that aspect. It seems clear that the LLRC thinks these features of the regime are obstacles to engage in reconciliation among the communities. In my view, these features pose a threat to the continuity of democracy in the country, not just reconciliation.

Whether the regime is serious in implementing these vital governance related recommendations must be judged from the past conduct of the Rajapaksa regime. The regime has failed to improve governance structures and, in fact, it has shown complete indifference to governance. If we have a quick look at its governance record, almost all the public institutions including regulatory institutions and law enforcement agencies were politicized. The constitutional guarantees available for protection against politicization were removed with the 18th Amendment to the Constitution. None of the assassinations of journalists and attacks on media institutions were seriously investigated. All the cronies of the government and their families are above the law. It has never taken steps to eliminate impunity. In my view, these are well planned strategies of the regime - for a clear purpose of tightening the political hold. If the governance related recommendations are implemented, then the Rajapaksa regime will lose its political grip and a fair political equilibrium will emerge. In my view, that is not a rick the regime will take.

Probing into bona fides of GOSL
---------------------------------------------
If the police are independent, being placed under an independent Police Commission as suggested by the LLRC, and de-linked from the military, and then we are bound to see a different police. Investigations will be conducted by professional policemen and evidence will be elicited, against any suspect, irrespective of the nature of the crime. They will not be subject to the dictation of the political masters. In such an event, there is a likelihood of successfully solving political or high profile crimes. Such independent investigations can expose the involvement of main players of the regime, who otherwise, comfortably sweep such investigations under the carpet and manipulated investigations. History has seen that when the law enforcement agencies become independent, corrupt leaders, including heads of the police department go to jail and new countries and new cultures emerge. That is exactly what happened in Hong Kong in late 1970s. Is the GOSL ready to accept it?

Take the case of killings of journalists, which have not been truthfully investigated by this government. There are at least two people who know those responsible for the deaths; the one who gave orders and the other who carried out the orders. If the police is given a free hand to investigate and prosecute the offenders, there is a likelihood of even judicial findings against the higher officials and politicians within the government. An investigation can expose those who were responsible for those crimes. World political experience show that such exposures have even brought down governments! Is the GOSL ready to accept it?

Freedom of expression, mostly political dissent, is something not new to President Rajapaksa because he was one who frequently used those rights at the highest level, while being in the opposition. Now, President Rajapaksha (and the regime as a whole) does not welcome any powerful dissenting grouping that can challenge his political future. However, the Government is at a natural advantage, because the people in the south honestly admire it for defeating the LTTE. The war victory (and popularity) is often used as the most powerful tool to suppress any dissenting voices. This reminds us of the famous quotation of Polybius: “Those who know how to win are much more numerous than those who know how to make proper use of their victories.” If free expression and lawful assemblies are permitted on sensitive political matters without impediment, alternative voices will certainly expose the government’s sham political devices and much more. Authoritarian tendencies will then be challenged openly. Is the GOSL ready?

The GOSL has mastered the control of media, through lawful and unlawful means. Apart from extra judicial tactics used by the GOSL with impunity, the entire state mechanism is now used for the protection and survival of the Regime. Besides, consider how the government reacts to anything that can “embarrass the government”. With that mind set, I do not see how there can be a political will to ensure full scale free expression and media freedom.

There may be other sensitive international and legal issues why the GOSL has some reservations on implementing the LLRC recommendations. On political expediency, GOSL will definitely answer affirmatively to the question, whether Sri Lanka has an independent and credible mechanism to investigate allegations of human rights violations and, in particular, the incidents during the last stage of the war. In my view, the GOSL cannot implement the governance related recommendations, simply because it believes that it is a political suicide to respect Rule of Law and protect human rights. Should the public be quiet then? As Martin Luther King Jr. said “Freedom is never voluntarily given by the oppressor; it must be demanded by the oppressed”. Unless there is sufficient and intensive demand by the people of this country, on the streets, in Sri Lanka, the GOSL will not even consider implementing these recommendations. Then, the LLRC would be a show piece for international consumption, without any relevance to Sri Lanka.

 

America advancing proposals against SL is a concocted brazen lie: hereunder is the truth

The SL authorities claim that this ‘hostile’ action is purportedly contained in the telex message sent by US State Secretary Hilary Clinton to SL foreign Minister. But according to this message , text of which is given hereunder there is no such proposal against the SL Govt.

The SL Rajapakse regime had earlier promised to the International community that after the recommendations based on the events during the war are made by the Lessons learnt and reconciliation Commission (LLRC) appointed by the SL Govt., an action plan will be brought before the Parliament. There it is stated that the Commission in its proposals to the Human rights Council has made mention that there occurred no such events and has forced to accept its recommendations . But before this , the foreign Minister had been invited for a discussion. It has been regretted that the LLRC has not inquired into whether the two parties have violated international laws during the war.

The members constituting the LLRC were not foreigners . They were appointed by the regime chief. Those are not recommendations which cannot be implemented. Like the opposition parties of SL , India too wanted them implemented. In those circumstances , it is only the mentally deranged and feeble who would claim ‘ proposals are antagonistic to SL’.

How can proposals recommending to restore Democracy in the country be against SL?

In a country where an individual is sentenced to a three year jail term , just because a journalist (female) with a tainted antecedence induced by bribes wrote an article in a newspaper based on statements purported to be made by that individual , and which allegations of the infamous journalist had no supporting evidence via a tape recording or any other , where can there be justice or lawfulness? How will the world treat the rulers of such a country who mete out punishment to an individual who is the victim of unsubstantiated accusations and who allow the journalist who blatantly lied and wrote a false story against him go scot free.
In a country where a notorious kudu (drug) peddler is a monitoring Minister in the defense Ministry , can such governance be democratic? Or a Mafia administration ? Didn’t no less a person than the Prime Minister of this Rajapakse regime himself admit that there are drug dealers among them?

In a country where law abiding citizens are forcibly abducted in broad daylight by the notorious criminal white Van and murdered ? can there be Democracy?

What prevails in this country is not only a flagrant breach of international laws , but even the sacrosanct rule of law of the country has gone to the dogs.

In such a country , when a proposal is made to it to enthrone Democracy , and if such proposals are construed by anybody as ‘ against the country’ is it not such a scoundrel a traitor ?

(Lanka-e-News-10.March.2012, 8.30PM) The much talked about draft of the US proposals against Sri Lanka was presented to the on going Geneva International human rights Council conference at its 19th session on the 7 th of March. The draft contained three grounds which the US State Secretary had earlier conveyed by cable communication to SL.

It urges therein that the SL Govt. expeditiously implements the recommendations of the Lessons learnt and reconciliation Commission (LLRC) appointed by the SL Govt. It also further notes that the SL Govt. had not paid attention to the charges leveled against it in the LLRC report of violating the international humanitarian laws.

In any event , the US while lauding the recommendations of the LLRC had via its proposals asserted that even as those recommendations are being implemented , the Govt. should take measures to create harmony among all Sri Lankans. It also adds that the SL Govt. should take responsible , independent , meaningful and confidence inspiring steps towards creating a climate where lawfulness and justice shall prevail.

The US proposal against SL mentions that a comprehensive plan pertaining to the implementation of the LLRC recommendations is presented to the Geneva conference. It also says that the UNHRC shall be allowed room to provide technological assistance and advice towards this .

It is the view of many that this draft is presented by the US to the UNHRC based on the confidence and conviction that it will be steered through successfully.

While Minister Samarasinghe , a Minister of the Govt. promises in Geneva that the LLRC recommendations will be implemented , racists Minister Weerawansa and Ven. Medhananda Thero , M P of the same Govt. have opposed and claimed that the LLRC appointed by the President is a conspiracy. In that case , then why are they sticking with a conspiratorial Govt. ? The best thing they can do in the best interests of all ,if they have true policies and integrity , resign and go. When Weerawanasa left the JVP seeking greener pastures for selfish gains , he told in Parliament in tears that he cannot ever forget a past incident , that is, how his father who felt his body was smarting went around to examine whether tires were burning.

If such an incident is not to recur, responsible measures are important and must be in place in relation to war crimes. Then, why is Weerawansa unable to understand this simple plain truth? Is he confirming the popular opinion about his stupid self that his head is full of gel outside and mud inside? Or has this Weerawansa transformed into a chameleon? Or has his tongue got bifurcated after he became a Minister?

These are the hypocrites who cannot hear anything regarding human rights safeguards as they become so uncomfortable for the most nefarious reasons .They behave like snakes which run amok when soaked in kerosene. When the whole world is revering human rights , aren’t we showing to the world that we are barbarians by openly criticizing them ? Weerawansa is pardonable because he has inborn ineradicable traits of serpents though he is in human form. This is confirmed by how he responds when it comes to respecting human rights obligations - like kerosene soaked snakes unable to bear the discomfort.
A Negro from an African country in his letter mentioned ,’The white men in the bygone era treated us as cannibals and locked our lips. Now, the whole world has realized that we are not that type. But , in your country , are barbarians ruling still? Otherwise why is your Govt. so afraid of human rights?’

Both the LLRC Commission and the international community are requesting to investigate the war crime charges leveled against both sides. Hence, the Govt. rejecting this request brings up the question whether the Govt. is opposed to the inquiring into the war crimes committed by the LTTE , because two of the main LTTE criminals among those who are living , K P and Karuna who are incriminated in the war crime charges are now with the Govt.

Once, our President told , ‘in our Buddhist country ,we don’t need Westerners to teach us human rights’. That is an absolute truth. We who have learnt how to show mercy to all living beings don’t need new lessons to learn human rights . When that is the case, why should we wait until the Westerners force us to implement the recommendations in the report of the LLRC appointed by the President? Shouldn’t we be ashamed of ourselves to wait ?

History teaches us that when Mihindu Thero , the son of the Emperor Asoka came to Mihintale to preach , he advised the then King Devanampiyatissa of Sri Lanka whom he saw was in a hunting spree to show mercy to all creatures. The King of SL heeded him immediately unlike our modern mahajara ‘Maharajas’, and did not summon his Council of Ministers immediately , to give instructions to burn the effigy of Mihindu Thero for advising him, and stage protests. Because of the vision and foresight of the Kings at that time , what valuable lessons we learnt as a nation.

Then , shouldn’t that sublime lesson learnt be followed today?

In 1971, there were 15000 murders; in 1988-89 , there were 60,000; in 2009 there was one lakh murders. In the past there were no responsible mechanisms . Whether they were there is not known. How many murderers are among us after committing war crimes in the past is also not known?

We must necessarily change the course of this journey.

Of course , Rajapakse regime and those with blood stained hands may not bother about human rights . But human rights must be safeguarded like how we protect our lives for the sake of our children and the future generation. A proper mechanism is indispensable for this. India to decide: Foreign SL ‘clowns’ murder their own hero when murdering the King -Is it wrong to advise Mahinda to eat his food cooked in his own fat before it is stale ?

(Lanka-e-News-12.March.2012, 11.45PM) While the debate on the budget was in progress in the Indian Parliament and when the Indian President Ms.Prathiba Patel addressed the Lok Sabha , Indian Parliamentary MPs shouted and protested against supporting Sri Lanka at the Geneva conference , the MPs had obstructed her speech which lasted about an hour on five occasions ,the Indian media reported.

MPs of Tamil nadu DMK and Andra Pradesh Congress parties together participated in these protests.

The force of the protests by Tamil nadu against supporting SL at the Geneva conference is much stronger than the mere blabbering of SL officials in Geneva that India will support SL at the conference. The Tamil nadu chief Minister had already written three letters to the Indian Prime Minister in this connection.

At today’s protests staged , it was apparent that the Andra Pradesh Congress MPs have also joined in the protests.

According to Diplomatic circles , the US Deputy Secretary of State Blake after informing SL when he arrived here some time ago ,that US is bringing forth these proposals at the Geneva conference , had visited India . Blake has then gone back after securing a definite answer from India. This means that India is not going to oppose the US proposals against SL at the Geneva conference.

Based on reports , there is a great likelihood of India refraining from voting. Already US is having 24 votes more than the necessary number in favor of its proposal , while SL has failed to exploit the situation to its advantage and bungled it in its characteristic boorish style. The Latin American and African countries have already stated that they will be voting in favor of the US proposal.

What is perplexingly interesting is , while the SL Rajapakse regime is creating the impression within SL among its people that the US proposal is anti Govt. and trying to provoke anti US sentiments , the International community is only asking to implement the recommendations of the LLRC appointed by none other than Mahinda Rajapakse himself.

The human rights activists in Geneva disdainfully say , the regime after getting cooked in its own fat is being asked to share and eat the food so cooked before it becomes stale. Hence , in these circumstances, those nincompoops who call these proposals as tantamount to an act of treason should be put in a lunatic asylum , as such a move will do immense good to them as well as for the country since the country is also being driven mad by these lunatics.

Meanwhile the SL Govt. spending money organized protests against Geneva in Italy and France via its SL embassies . But as usual the protests did not receive a good response going by the paucity of crowds.
At the demonstrations organized in Rome , on the banner what was intended to be written was ‘President is a ‘Hiro’ instead ‘Hero’. Unfortunately , for some inscrutable reason , there had crept in a howler in the writing which resulted in the words conveying a filthy meaning . Of course though the regime could not achieve the result it expected , this howler served as a joke to be talked about and laughed at for a long while. When the English language is expressed wrongly , such expressions are referred to as ‘ murdering the King’. In this instance , while murdering the King, they had murdered their ‘ Hero’ and made him a zero. The final outcome was : it was proved to the world that these cardboard patriots who talk so loudly about country’s prestige cannot write even a few words properly – being filthy themselves in mind and body ,they showed clearly it is filth that comes out even in their writing. People’s group seeking to rescue MaRa regime dissolves like salt in rain

Those who came to join in the campaign at Fort did not come of their own accord, but rather because they were forced via threats that they will be deprived of their jobs, if they don’t participate. Those who came were temporary and probationary Govt. employees who had been threatened that they will not be made permanent if they don’t take part in the campaign. The crowd gathered by the outstation organizers was a flop going by the paucity of crowds in the buses that brought them to Colombo.

Following the assassination of Bhaaratha Lakshman , an SLFP union leader , a majority of the members of the trade unions are disillusioned and resentful against the regime. Consequently , their response was extremely poor.

The protest campaign to rescue MaRa regime got dissolved like salt literally and metaphorically at the very beginning itself with the onset of rains . Those few who took part also were anxious to get back to their homes fast. It will not be a matter for surprise if cardboard patriot like Weerawansa whose head is full of gel outside and mud inside accuses that the downpour was also a result of the conspiracy of foreign imperialists.

Ven. Elle Gunawansa , the racial Thero and supporters to MaRa regime like him were conspicuously absent for the demonstrations . They stated , they will come to rescue the country,’ but we will not come to rescue this family’.

But , of course , Weerawansa and Jackson Anthony , the ‘actors’ notorious for their play acting and who blow the trumpets of the regime for filthy lucre were present in the midst.
The most ludicrous side of this whole comedy drama enacted today purportedly aimed against the recommendations that are being made to the UNHRC is, these recommendations are really being presented only on or about the 20th of March. In fact , at today’s opening sessions , S.L representative Mahinda Samarasinghe was making his address. It is therefore doubted whether today’s protests and ballyhoo were directed against his address, by these morons and stray mongrels who cannot identify day from night.

No matter what, the ‘people’s group’ campaign conducted today amidst the unbearable hardships faced by the trampled and downtrodden masses was a flop.

(Lanka-e-News-27.Feb.2012, 11.45PM) The MaRa regime which had heaped unbearable economic burdens and hardships on the people thereby provoking their monumental resentment and opposition, found in the present Geneva human rights conference an escape route from people’s bitter hostilities against it . The regime by launching the campaign, ‘people’s group against foreign invaders’ directed against the UN human rights conference is diverting the attention of the abysmally suffering people from their dire woes currently besetting them. In any event , according to our outstation correspondents , this campaign had been unsuccessful at village levels.

In most areas , the Govt. employees at District Secretariats and Govt. offices have been forcibly brought to participate in the protests . Yet these protests have not lasted more than half an hour, reports say. In some regions a parcel of lunch and a Rs. thousand had been given as an inducement to make them join in the protests.

Nishantha Ubeywansa ,the Dep. Director General of National Rupavahini TV channel has personally gone to various places and had forced outside workers also to take part in the protests, and threatening them that , otherwise they stand the risk of losing their jobs. This Director General had conducted himself in a manner that is worse than that of an underworld unlawful criminal who threatens the law abiding citizens if they lawfully report him to the police. Dayaratne Ratgedera and present Chairman Mohan Samaranayake, who held a post in the UN formerly, have also begun running wild in all directions in search of people for the campaign claiming there is not enough crowd for the demonstrations.
It is view of the majority that the notification issued by the Three Maha Nayakes to rescue the MaRa regime at this juncture is a most grave insult inflicted on the Buddhist people of this country , because this notice has been issued , despite the fact that the Maha Nayakes whose eyes and ears are open being fully aware of the raging lawlessness in the country and atrocities committed on the people by the MaRa regime including the following :

Suspects brought to courts being abducted by the White van even while they are within the court precincts; Judges are attacked on the middle of the roads ; while the people who provide the public funds to run and fatten the regime are plunged into starvation and hardships , the regime ruthlessly imposing unending burdens – introducing a recent 40% fuel price hike among other hikes; the son of regime’s ‘Maharaja’ taking part in car races in showy luxurious Lambogini car in ‘mahajara’ manner while people are struggling even for a square meal a day ; and MaRa regime shooting at and killing people who are abysmally suffering and therefore protesting .

Regime’s representatives pitted against each other- demons oppose the Geneva recommendations but deities support them

(Lanka-e-News-26.Feb.2012,11.45PM) While the sessions of the United nations human rights Council (UNHRC) are scheduled to commence tomorrow (27) in Geneva, it is reported that the representatives of the ruling regime of Sri Lanka (SL) who have gone there have split into two hostile groups whereby they are plunged in dire straits and in a serious muddle.

This rift has arisen between foreign Minister Dr. G L . Peiris and President’s special representative Minister Mahinda Samarasinghe who are both there.

As the President’s special representative is getting the opportunity to address the UNHRC conference at the beginning , and the foreign Minister is only to make his address subsequently , this dispute had flared up , and the rift had deepened between them, it is learnt.

At any rate , the recommendations which the SL Govt. is being pressurized to implement are being taken up at the concluding stages of the conference. These recommendations have by now become public knowledge. Those who have even an iota of thinking power will not construe them as a conspiracy against SL.

The recommendations are given hereunder :

1. Calls on the Government of Sri Lanka to implement the constructive recommendations in the LLRC report and additionally to take immediate steps to fulfill its relevant legal obligations and stated commitment to address serious allegations of violations of international law by initiating credible and independent investigations and prosecutions of those responsible for such violations,
2. Requests that the Government of Sri Lanka present a comprehensive action plan before the 20th session of the Human Rights Council detailing the steps the Government has taken and will take to implement the LLRC recommendations and also to address alleged violations of international law,

3. Encourages the Office of the High Commissioner for Human Rights and relevant special mandate holders to provide, and the Government of Sri Lanka to accept, advice and technical assistance on implementing those steps.
The third recommendation herein is very important. It has been proved beyond doubt that any group appointed by SL regime chief sans international assistance turns out to be puppets and dummies of the regime , and stoops to any sordid and unscrupulous activities. A case in point is the Committee appointed to probe the colossal blunders tainting the recent G C E exam results .

Though these recommendations are deemed as poison by the regime , its racialists and politicians, yet , to the people in this country these recommendations are too lenient, akin to a drop of water being given as relief to the people suffering in a torrid desert who are helplessly witnessing the following atrocious lawlessness and crimes committed openly in their midst:

Suspects in cases being abducted in the white Van with impunity while being within the court precincts; Presidential advisor getting killed in broad daylight on the main highway while police chiefs are watching from behind tinted glass in vehicles; media personnel abducted unendingly; media Institutions being torched and bogus stories concocted by the police that condoms were found in the charred premises ,instead of apprehending the criminals who are still scot free even nearly two years after the incident; a most responsible President ,the highest in the hierarchy most ruthlessly and irresponsibly telling openly ‘ I have given orders to attack him and finish ’ against his own supporter , before his MPs; when people ask for a reasonable price for fuel and oil , and request not to prune down their salaries , police resorting to shooting until killing and blowing the heads of civilians into smithereens.

When demons and donkeys are opposing these recommendations, deities and humans are supporting them

Based on information reaching us from foreign diplomatic circles , these recommendations are sure to succeed.

Meanwhile the ruling regime is to stage protests tomorrow against these recommendations. All Govt. employees have been forced to participate. Leave as well as full salary are being approved to them in this regard.

Sarath Fonseka is a political prisoner internationally, the national campaign for the release of Fonseka has issued a notification to hold a public rally on the 29th in Colombo demanding the restoration of the political, voting and civil rights to him.

The notice issued by the convener of this campaign , Kumara Alagiyawanna under his signature is as follows :

The US has officially accepted that General Sarath Fonseka is a political prisoner following the petition presented to it bearing the signatures of 25000 Sri Lankans organized by Gen. Fonseka’s daughter Apsara Fonseka . The General who is now imprisoned unlawfully and on false grounds has been declared and confirmed officially as a political prisoner by the United States of America .

Therefore , we officially demand the SL President and the Govt. to accept the General as a political prisoner and to vest him with all the rights he is entitled to acceptable internationally .

We hereby demand the Govt. to immediately restore to General Sarath Fonseka all the civil rights including contesting elections, participation in political affairs, writing , making announcements and expressions, and meeting political activists and politicians.
The national campaign for release of Gen. A powerful country begins investigating illegal deals transacted by regime

Fear gripped 'BayaGotha' blabbers out his deep rooted fears

This fear and panic had been triggered with the commencement of the first of the series of protests which was staged on the 29th of November 2011 when over 25000 people for the first time joined in the protests in Colombo demanding the release of Gen. Fonseka together with a number of Organizations along with the UNP. As soon as these ominous signals began to emerge to the detriment of the MaRa regime , so also changes began to occur in the UNP presumably based on the Govt.’s panic and therefore its underhand machinations, with Grero , a UNP er for whatever reason , selfish or otherwise crossing over to the Govt. ranks on the following day. The next day using Sajith, Karu Jayasooriya was prompted as a rival candidate to the UNP leadership. In consequence of these machinations , the monumental wave of growing protests against the Govt. demanding Fonseka’s release was temporarily stalled. However , BayaGotha (coward Gotha)'s acute fear gripping him came to light in respect of the massive student demonstrations staged by the Sinhala and Tamil students lately. Fear and paranoid ridden Bayagotha in an unguarded moment blabbered as follows :

‘It is very clear to us ,that groups which have been witnessing the overthrow of the regimes in Tunisia, Egypt and Libya by agitation and protests, and who have been unable to acquire power by Democratic means are seeking to oust the Democratic govt. of this country via illicit processes’.

Blabbering Bayagotha made two serious mistakes in this announcement : the first was, naming this Govt. as a ‘Democratic Govt.’ Like how he says ‘it is clear to us’ , it is very clear to all of us including the world that this Govt. is not Democratic at all.
This is a Govt. which came to power by fraudulent means 'pickpocketing' the victory that belonged to another through a gross computer manipulation of the election results. Moreover, this is a govt. which commits abductions and murders via white Van abductions while also ruthlessly raping and killing even foreign tourists, let alone locals . In other words, this is a Govt. which is not second to that of Idi Amin in conducting itself as a licensed rapist , murderer and abductor , for a majority of its stooges and henchmen are committing these crimes with gay abandon since they are fully aware that they enjoy absolute impunity. Hence, Bayagotha identifying this Govt. as a Democratic Govt. is akin to the Govt.’s incapacity to identify the ‘Z’ score at the G C E adv. Level examination , whereby many lakhs of students have been plunged into despair while also their future is blasted.

The next grave blunder this Bayagotha committed was , describing the groups which were agitating duly and rightly protesting as illicit action. Even the UN Organization has made it abundantly clear that people have an absolute right to engage in peaceful protests and demonstrations., and is an universally accepted norm. It is hence a fundamental right an individual enjoys in a Democracy.

Lest Bayagotha , a citizen of America has forgotten the basics of fundamental and human rights , may we point out to him nobody needs his permission to enjoy those rights , despite his maniacal obsession with his criminal white Van operations and crimes committed on law abiding citizens to instill fear in them.

It is therefore best if the MaRa regime and Bayagotha decide that before the storms of protests reach uncontrollable proportions, and they are forced to seek a hiding place worse than the drain in which Gadaffi hid in his final days , they think of a way to enthrone Democracy and rule of law, by stepping down from their despotic throne of rule of force and culture of murder.

Another case of pressurizing Court by MaRa; Bouquet for AG


(Lanka-e-News-29.Feb.2012, 3.30PM) A quantity of pesticides which was a subject of bitter controversy on the ground that it contained arsenic and was prohibited on a court decision , have been released illicitly flouting the court procedures , according to reports reaching Lanka e news.

The Courts had earlier given an order that these pesticides suspected of containing arsenic shall not be released by the Customs.

Following the Environmental Organization petitioning the court again , the court have after examining the petition had issued summons to the Customs Director General and the Registrar of pesticides to appear in court, for flouting court directives.

The Customs Director General and the Pesticides Registrar after the summons were served on them , have met the Attorney General (AG) and asked her to help them out of this illegal acts of theirs. The present AG , Ms. Eva Wanasundara who does not stoop to sordid activities and unscrupulous conduct unlike the former AG Mohan Peiris who descended to any level to do all the illegal biddings of the MaRa regime , has refused to do anything outside the Court procedures to help the two crooked criminals.

These two crooks who knew that it is only a bigger crook than they who can solve their problem had met the regime chief. The latter had unhesitatingly ordered the court to cast aside this case. ( Lanka e news had already reported in respect of the present chief justice as having transformed into a No. 1 bribe taker.)

It is learnt that this quantity of pesticides containing arsenic confiscated by the Customs had been imported by a Company of a notorious businessman , Dhammika Perera , who is a close associate of the MaRa regime.

During the recent past when Minister Mahinda Samarasinghe who led a mega team to the Geneva UN conference gave a list of names of Lawyers from SL who are Govt. henchmen from the AG’s Dept., to accompany him on the tour , to the present AG ,who had advised the Minister that the list of names of lawyers should not be those whom the Minister fancies , but rather they should be competent Lawyers as judged by the AG’s Dept. and hence that selection is her task.

In the present climate when every Institution is being run sans adherence to laws, the refreshingly salutary attitude of this female AG must be looked upon with great respect and admiration by the whole country and its people . Of course in the lawless atmosphere , she conducting herself with rectitude , dignity and integrity fearlessly is to incur great risks of victimization and vengeful reprisals . judgments should not be given for personal benefits -HC Judge Warawewa

(Lanka-e-News-10.Jan.2012, 8.30PM) Judges should not give personal judgments in the hopes of gaining financial benefits, High Court judge W.M.P.D. Waraweva, who gave the dissenting judgment in the Sarath Fonseka court case, stated in open court today (January 10).

He stated this after giving the verdict in a murder case.

He stated that judges should not give judgments and verdicts in the hopes of gaining personal benefits or in fear of losing their luxuries while judgments should not be given with the hopes of putting an individual in trouble or assisting another.

Waraweva said that he has always given his judgments according to his Buddhist faith and that he has never worked with the purpose of pulling cases from other courts towards him.

The High Court gave the death penalty to the two accused murder suspects after finding them guilty.

Last November, Sarath Fonseka was found guilty by a divided decision in the case regarding the ‘White Flag’ statement and sentenced to 3 years in prison by the Colombo High Court today (November 18).

The verdict divided 2:1 was given by the High Court bench, headed by Judge Deepali Wijesundara and comprising Judges DMPD Waraweva and Zulfiqar Razin.

Justice Waraweva giving his judgment deliberated that Fonseka was not guilty on all three charges while Justice Wijesundara and Rashim found Fonseka guilty of the first charge, of inciting violence through his statement, and found him not guilty on the second and third charges.

(Lanka-e-News-02.March.2012, 10.30PM) The Sri Lanka (SL) regime chief Mahinda Rajapakse is having highly secretive discussions with a group of representatives of a European State who had cordial relations with SL during the period of the SL war, in regard to methods and means to extricate himself from the US recommendations that are scheduled to be brought before the human rights conference now in progress in Geneva, according to reports reaching Lanka e news from sources within the Temple trees.

These discussions had been taking place yesterday and day before late in the nights after the employees of Temple Trees have gone home after work.

The European representatives have during the discussions given a list of the names of army officers who are charged for war crimes to the regime chief, and have stated that the US recommendations to be brought before the Geneva Sessions can be averted.

The regime chief who blabbers that he will not betray the Army officers even if he is to face the electric chair punishment has agreed with the European representatives. In any case nothing conclusive has been arrived at, it is reported.
The war crime charges which are likely to be proved have been so far leveled against Gotabaya Rajapakse publicly or unofficially. That is , Gotabaya giving orders to kill those who surrender carrying white flags. It is learnt that there are evidence to substantiate that accusation against him.

No matter what , according to Temple trees informants , these secretive discussions are selfishly aimed at saving the Rajapakses while sacrificing a group of Army officers.
