Prasanna Alwis the judge hearing Baratha trial gobbles back his own vomit due to guilt and uneasy conscience

(Lanka-e-News-19.April.2012, 2.00PM) Magistrate Prassanna Alwis while hearing the preliminary evidence in the case on the ghastly murder of four individuals including Bharatha Lakshman Premachandra was gripped by such a fear psychosis unbecoming of a Judge of integrity that he was in a state of nausea , mania and near mental breakdown condition resulting from his own guilt and uneasy conscience. If any judge who rejects an argument in court , but later accepts the same subsequently without justification or reasons to uphold the argument is not a judge who should be gracing the bench but an animal who should be kept confined to a kennel where like a dog he can eat back the very vomit he threw out . Just because he has no tail like a dog, that does not mean Prasanna could mount the hallowed bench and disgrace it.

Prassanna Alwis who decided earlier while gracing the hallowed bench that President’s Counsel Hemantha Warnakulasuriya cannot appear on behalf of Duminda Silva , a prime suspect , and who is not in a fit mental condition , did a most sordid U turn , and said today, Warnakulasoriya can appear on behalf of Duminda , not only eating his own words but even his own stinking vomit he regurgitated earlier.

Judge Prassanna Alwis who gave an earlier order to the CID to arrest the accused Duminda Silva , shamelessly fudged today, saying a warrant is not necessary to arrest this same suspect Duminda Silva. It is most significant to note that this unscrupulous judge stated this , even after the CID notified court that Duminda is taking treatment at Mount Elizabeth Hospital , Singapore , and Lawyer Tirantha Weraliyatte appearing for Late Baratha Lakshman made a request to issue a warrant to the Interpol to arrest Duminda. How else can Magistrate Prassanna be described than as in the previous paragraphs as an animal which swallows the same vomit it regurgitates , when he says a warrant is unnecessary to arrest Duminda whom Prassanna himself named as a suspect previously and ordered that he be arrested . Mind you , Prassanna even declared it is unnecessary to issue a warrant of arrest even after he being made aware fully by the CID that the suspect is now in Singapore. It is widely questioned following this attitude taken by Prasanna whether he is a magistrate or a manimal ?

If Magistrate Prassanna Alwis cannot take action against the CID for not acting on his official directive , of what worth is such a judge and to serve whose purpose is he sitting on that lofty seat .Isn’t it better if Prasanna hands over his seat in the bench also to the CID and goes to the paddy field and does some ploughing , in which case he could prove he is more useful to the community as a farmer ? Isn’t it because of judges like Prasanna who are disgracing the bench instead of gracing it that the entire nation has lost faith in the judiciary which was held in high esteem at one time?

The CID told the court today that Duminda Silva M P. had been injured in his head and a number of surgical operations had been performed on him , and another operation is to be performed on him
again next month.
Lawyer Waraliyadhe appearing on behalf of late Bharatha Lakshman pointed out that the CID is neglecting its duty time and again to arrest the suspect Duminda Silva , and therefore to issue a warrant to arrest Duminda.

The CID which opposed this , stated that a warrant is not necessary to arrest Duminda Silva, and the latter can be taken into custody without a warrant.

Not enough the insult he poured on the judiciary thus far by his conduct , Prassanna Alwis even went further to say additionally that Duminda Silva is not only a suspect but he is also a casualty.
From this comment of his it is abundantly clear that Prasanna is biased in favor of the suspect , and needs to be removed forthwith from his judicial status without permitting him to further degrade the judicial standards. This same magistrate who previously said , Meryl Ranjan of the CID was liable for contempt of court for neglecting court , and issued a notice on him , gave a contrary order today that Meryl Ranjan is not guilty of such a wrong thereby retracting his own words.

After committing all these glaring indiscretions and judicial lapses like a mouse , Prasanna suddenly transformed into a lion without a tail , and roared , if anybody is aggrieved by his actions , they can complain to the higher courts, implying that he is imbued with self guilt and prejudice , two evil traits a judge should shun.

This magistrate named Duminda Silva as a suspect after the latter was dispatched abroad by President Rajapakse. Moreover , at the time when the shootout took place between the two factions, SSP Deshabandu Tennekoon who was allegedly present on the scene had not been summoned to court as a witness.

The court decided that the case be postponed until the 27th , and the 13 suspects be held in remand custody.
Hirunika Premachandra , the widow of late Baratha Lakshman who produced two photographs to the media which depict Baratha fallen on the highway after he was brutally shot at on the day the shooting took place , stated as follows after the trial :

‘Here lies my husband. This is a picture which shows how he was fallen on the main road after he was shot at. Let me first hope that no wife in this world will be unlucky to see her husband in a state as this. Now , six months have elapsed since this tragedy occurred , but the police officers are doing their utmost to discontinue the investigation.
Nothing had been done for the last six months. The prime suspect Duminda Silva is still free. I like to ask these officers , if they are in my shoes , will they conduct themselves in this manner? What are they doing?. Of course death is true to all. But let me emphasize that nobody has a right to take away the life of another. Today , not only the family of Baratha Lakshman Premachandra , but the entire country is watching over this issue. Hence , all of us are demanding justice, no more no less. If justice is not meted out , the entire crowd behind me will gush forward to accomplish it’, she asserted.
