Herein is the Draft resolution of National campaign to install good governance and create just society

(Lanka-e-News-09.April.2013, 11.55PM) The most Ven. Madhuluwawa Sobitha Thero , presented the draft of the constitutional amendment via the 19th amendment prepared by the National campaign enumerating the measures that should be taken to get rid of the Executive Presidency and aimed at creating good governance and a just society, to the Mahanayake of the Asgiriya Malwatte chapter who received it first.

This draft amendment had been prepared by the PC Jayampathy Wickremeratne , senior reputed Lawyer JC Weliamuna and a team of the intelligentsia of the country .

This draft stipulates that the abolition of the Executive Presidency shall not drop dead in its tracks as merely an election promise , and what ought to be the measures that should be truly taken. In fact this abolition method is a struggle.

The Ven. Sobitha Thero stated that it is possible for this government that has a 2 / 3rd majority to pass this draft resolution .After JR Jayawardena , not only Sirima Bandaranaike of the SLFP; Samasamajaya Dr. N .M. Perera; Communist party ; Ex President Chandrika Bandaranaike , but even the present President Mahinda Rajapakse in his Mahinda chinthana first , and the second ,it had been declared that the Executive Presidency is pernicious to this country , and therefore should be abolished.

This being the duly accepted and acknowledged position , this Executive Presidency shall be abolished immediately and good governance shall be installed , because this abolition is not going to be inimical to anyone, Ven. Sobitha Thero explained. If this request is not going to receive any response from the President or the government ,then at the next Presidential elections , a candidate shall be fielded with the sole aim of abolition of the Executive Presidency , and within 120 days of the victory , the Executive Presidency shall be abolished , and good governance installed , Ven. Sobitha Thero clearly enunciated.

The methodology to be adopted to abolish Executive Presidency and install good governance is as follows :

Proposals for constitutional reform

The NMSJ proposes the following to be included in the election manifestos of political parties and candidates and then move on with the amendment immediately after the Elections:
1. Abolition of the Executive Presidency

The Executive Presidency shall be immediately and totally abolished with a return to a Parliamentary form of Government.

The President shall be elected by Parliament and shall act on the advice of the Prime Minister, unless when there is express constitutional provision to the contrary.

No person shall be eligible for election as President or a Vice President unless such person is a citizen of Sri Lanka, has completed the age of 35 years and is qualified for election as a Member of Parliament.

The President shall appoint as Prime Minister, the Member of Parliament who, in his opinion, commands the support of the majority of Members of Parliament. The Prime Minister shall be deemed to have resigned if Parliament passes a motion of no-confidence against him, the Appropriation Bill is not passed and when Parliament is dissolved.

The President shall be the head of the Caretaker Government during Parliamentary elections.

2. Vice Presidents
There shall be two Vice Presidents who shall be from different communities and different to the one to which the President belongs. They would be elected by Parliament.

3. Constitutional Principles:

Proposed Article 8A:

(1) The Republic of Sri Lanka is founded on the following values:
(a) supremacy of the Constitution and the rule of law;
(b) representative democracy, human dignity, the achievement of equality and social justice and the advancement of fundamental rights and freedoms;
(c) racial, religious and gender equality; and
(d) universal adult suffrage, regular elections and a multi-party system of democratic government.

(2) Legislation or conduct inconsistent with the Constitution shall be void. It shall be the duty of the State and all persons to respect the Constitution.
(3) The peoples of Sri Lanka who together constitute the People of Sri Lanka have the right to develop their own language, protect their own religion, to develop and promote their culture, to preserve their history and the right to their due share of State power including the right to due representation in institutions of government, without in any way weakening the common Sri Lankan identity. This shall not in any way be construed as authorizing or encouraging any action which would dismember or impair, totally or in part, the territorial integrity or political unity of the Republic.

4. Language

At present, Sinhala is the official Language, Tamil is also an official language and English is the link language. Sinhala and Tamil shall be declared as official languages while all three languages shall be national languages, as was proposed in the Constitution Bill of 2000.

5. The duration of Parliament shall be 5 years.

6. Caretaker Government

There shall be a Caretaker Government during the period of Parliamentary elections. It shall have the powers of the Cabinet of Ministers. The Caretaker Government shall consist of the President, the two Vice-Presidents and a member each appointed by the outgoing Prime Minister and the Leader of the Opposition who shall not be candidates at the Parliamentary elections.

7. Constitutional Council

The Eighteenth Amendment shall be abolished and the Seventeenth Amendment would be brought back with suitable amendments, including those proposed in the draft report of the Parliamentary Select Committee chaired by Hon. DEW Gunasekera. The composition of the Constitutional Council will be designed to strengthen the 17th Amendment further.

8. Appointments to High Posts and Independent Commissions
Appointments to the following positions shall require the approval of the Constitutional Council:

Chief Justice and the Judges of the Supreme Court
President and the Judges of the Court of Appeal
Members of the Judicial Service Commission other than the Chairman
Attorney-General
Auditor-General
Inspector-General of Police
Parliamentary Commissioner for Administration (Ombudsman)
Secretary-General of Parliament

Members of the following Commissions shall be appointed by the President on the recommendation of the Constitutional Council:

Election Commission
Public Service Commission
National Police Commission
Human Rights Commission of Sri Lanka
Permanent Commission to Investigate Allegations of Bribery or Corruption
Finance Commission
Delimitation Commission

In the case of the Chairmen of such Commissions, the Council shall recommend three persons for appointment, and the President shall appoint one of the persons recommended as Chairman.

9. Size of Cabinet

The number of Cabinet Ministers shall not be more than 25. The total number of non-Cabinet Ministers and Deputy Ministers shall not be more than 25 and no other Minister in whatever description would be permitted.

10. Electoral reform

The new electoral system shall be a mix of the first-past-the-post (FPP) and proportional representation (PR) systems. Preferential voting shall be abolished. The ratio between MPs elected under the first-past-the-post (FPP) and proportional representation (PR) systems and also whether proportional representation should be national, provincial or district have to be agreed upon. Reaching agreement would have to be done under the new Parliament and the new electoral system will thus necessitate a further constitutional amendment.

However, political parties could commit themselves to a mix of FPP and PR and doing away with the preferential voting system.

11. Cross-over of MPs

MPs elected on PR lose their seats if they cease to be members of the Party and such vacancies shall be filled by the party. MPs elected on FPP lose their seats but a by-election will be held.

Presently, although an MP who loses membership of the Party loses his seat unless the Supreme Court holds that his expulsion is invalid, MPs go to the District Court and get an injunction, stalling disciplinary proceedings. This could be prevented by providing that the Supreme Court shall have sole and exclusive jurisdiction relating to disciplinary proceedings relating to MPs. This amendment need not wait till a new electoral system is agreed upon.

12. A new fundamental rights chapter

The Bill of Rights mentioned in the National Human Rights Action Plan is a good basis for a new fundamental rights chapter. However, it has not been discussed enough in the country and, as such, this should come after more debate, possibly along with electoral reform. Since the issue of the Right to Information has been widely discussed it could be introduced immediately.

Political parties shall commit themselves to a new Bill of Rights that improves on the present fundamental rights chapter by expanding the scope of civil and political rights and by the inclusion of social, economic, cultural rights as well as women’s and children’s rights.

13. Enforcement of Fundamental Rights

The following provisions can be included immediately.

All existing laws and written laws, except personal laws, shall be read subject to the fundamental rights chapter.
The remedy for infringement of fundamental rights and language rights will be available against all State action. A fundamental rights application may be made by a relative or friend of the aggrieved person or in the public interest. There shall be no time limit for filing an application, as is the case in writ applications.
Although the President is non-executive, he would still perform executive acts on the advice of the Prime Minister. Such executive action shall be subject to judicial review.

In the case of judicial action violating fundamental rights, compensation shall be paid by the State.

14. Constitutionality of legislation

A Bill shall be published in the Gazette at least 2 weeks before being placed in the Order Paper. There will be no “urgent” Bills.

Post-enactment judicial review of legislation shall be permitted.
The Supreme Court shall have power to make a declaration that any law passed by parliament or statute made by a Provincial Council or any provision of any such law or statute is inconsistent with the Constitution and invalid to the extent of the inconsistency. However, in order to mitigate hardships that may be caused to persons by who may have acquired certain rights under the legal provisions being struck down, the Court may limit the retrospective effect of the declaration of invalidity or make an order suspending the declaration of invalidity for such period and subject to such conditions as would enable Parliament or a Provincial Council to take steps to make the impugned law or statute cease to be inconsistent with the fundamental rights chapter. The Indian Supreme Court has used the tool of “prospective over-ruling”, limiting the retrospective effect of a declaration of invalidity in appropriate cases. Section 172 of the South African Constitution expressly permits such limitation.
Article 84 (Bills inconsistent with the Constitution) shall be deleted.

15. Impeachment of Judges of the Supreme Court or the Court of Appeal

Provisions similar to those found in the Constitution Bill of 2000 shall be introduced. An inquiry will be held, in the case of the Chief Justice by a committee consisting of three persons each of whom hold, or have held, office as a judge in the highest court of any Commonwealth country and in the case of any other judge by a committee consisting of three persons former or present Judges of the Supreme Court or the Court of Appeal. The procedure to be followed, the mode of proof, burden of proof and the standard of proof of any alleged misbehaviour or incapacity and the right of the Chief Justice or such Judge to appear before and be heard by such committee in person or by representative shall be provided by law.

PREAMBLE
-----------
The Second Republican Constitution was adopted in 1978 to provide for the economic, political and social development of the country. It achieved the expected objectives including the socio-economic transformation of the country, to a great extent.

During the last several years under Mahinda Rajapaksa's regime, the office of Executive President has been completely desecrated, by destroying all the checks and balances that were built into the system. The dignity and the integrity of that office has been reduced to a despicable state as a result of the blatant abuse of power and the creation of an authoritarian regime marked with extreme nepotism and corruption, with gross disregard for democratic values and fundamental human rights.

There is now an urgent need to restore the dignity and sovereign rights to the People which were forcibly taken away by the present regime, and to adopt a new Constitution for:

- the establishment of a just and equitable society, creating an environment for all people to live in peace and harmony while enjoying their fundamental rights, irrespective of any difference of creed, religion, language or political opinion;
- the establishment of a vibrant and prosperous economy, (which has been completely destroyed in the recent past), including the creation of opportunities to generate income for the people;
- the restoration of the independence of the judiciary, law and order, which has been critically and unprecedentedly debilitated during the recent past;
- the restoration of the pristine glory previously enjoyed by Sri Lankans in the International arena.

Main features of the Constitution proposed to be adopted by the United National Party Government

Sovereignty is in the people and is inalienable.

Sovereignty is exercised directly through universal suffrage, and includes the following fundamental rights:
a. Universal access to education,
b. the right of persons belonging to a religious or ethnic community to enjoy their culture, practices and their religions and use their language,
c. Right to good administration.

The Sovereignty of the People requires that Parliament and the Government are accountable to the people.

01. Restoration of the People's Sovereignty
----------------------------------------
i. The Constitutional framework will enshrine the Rule of Law within a democratic framework. Not only the ruled but the rulers are also subject to the Rule of Law.
ii. Buddhism will be given the foremost place while assuring the rights of all other religions in compliance with the International Covenant on Civil and Political Rights (ICCPR).
iii. Fundamental human rights shall be guaranteed and secured for each and every person irrespective of any race, religion, language, caste, sex, political opinions or any other differences.
iv. The Directive Principles of State Policy imposes the duty and the responsibility upon the State to provide necessary facilities for good health, opportunities for employment, access to education, protection of family rights, children and women’s rights, rights of senior citizens and disabled persons.
v. The Constitution will guarantee the freedom of expression and will be strengthened to include the right to information.

02. Legislature
---------------------
i. Parliament shall consist of 225 members elected on a mixed system where each constituency will elect its representative and the final result (seats in Parliament) will reflect the Party's true strength (i.e. total votes polled) at elections. This system will give value for every vote cast.
ii. The system of preference votes will be abolished.
iii. The tenure of the Parliament and the Provincial Council is fixed at five years.
iv. Elections for the Parliament and all Provincial Councils shall be conducted on one and the same day, and in the event the Head of State is also to be elected, that election will also be held on the same day.
v. Any Member of Parliament or a Member of any Provincial Council or a Member of any Local Government Institution who loses the party membership from whichever Party he/she is elected/appointed to that institution shall cease to be a Member of that institution forthwith.
vi. If any Member of Parliament, or a Member of any Provincial Council or a Member of any Local Government Institution fails to submit Annual Declaration of Assets and Liabilities within the stipulated time period, he/she shall cease to be a Member of that body. Ministers and Deputy Ministers shall also be required to submit their Annual Declaration of Assets and Liabilities to the Speaker instead of the Executive as it is done now.
vii. If any Member of Parliament, or a Member of any Provincial Council or a Member of any Local Government Institution is convicted for a crime irrespective of whether he/she serves a jail sentence or not, he/shall shall cease to be a Member of that body.

03. Executive
-----------------------
i. Presidency will be abolished.
ii. Instead of the Executive Presidency, a Head of State will be substituted. The current powers conferred on the Executive Presidency will be divided among the Head of State, the Prime Minister, and the Speaker's Council.

Option 1 : A Prime Minister elected by the people at an election to govern with the Cabinet. The Prime Minister and his Cabinet are responsible to Parliament.

Option 2 : As a novel system the executive powers will be exercised on apolitical basis and to be subject to checks and balances.
2.1 : To ensure direct exercise of the People's Sovereignty, the Head of State will be directly elected by the people.
2.2 : The Head of State will be the Head of the Council of State (which will consist of the Prime Minister, Leader of the Opposition, the Leaders of the political parties represented in the Parliament and the Chief Ministers of the Provinces), and will act on the advice of the Council of State.
2.3 The Council of State shall decide on all political directions and national priorities. The Cabinet of Ministers headed by the Prime Minister and the Provincial Boards of Ministers shall be responsible for implementation of the decisions of the Council of State.
2.4 The decisions of the Council of State shall be by consensus. In the event there being no consensus the majority decision will prevail. This will pave the way to practice Lord Buddha's preachings on governance – peaceful assembly, peaceful dialogue and peaceful dispersion.

Option 3 : To adopt a system similar to that of the Westminster system.

iii. The Cabinet of Ministers will be restricted to 25 including the Prime Minister.
iv. There shall be a Speaker's Councils consisting of the Speaker, the Prime Minister, and the Leader of the Opposition and representatives of all political parties represented in Parliament. The Speaker shall be the Chairman.
v. On recommendations of the Council of State, the Head of the State shall appoint members to Independent Commissions, Justices to the Constitutional Court and Superior Courts. Heads of State Institutions shall be appointed by the Head of State with the approval of the Speaker's Council.

04. Devolution of Powers
----------------------------
i. While Sri Lanka remains a Unitary State, powers will be genuinely devolved to Provincial Units taking into consideration:
a. The Joint Communiqué between the Government of Sri Lanka and the Secretary-General of United Nations in May 2009;
b. Resolutions on Sri Lanka at United Nations Human Rights Council;
c. Tissa Vitharana Report and the connected documents including papers exchanged at the talks between the SLFP and the TNA;
d. Recommendations of the Lessons Learnt and Reconciliation Commission;
e. President Mahinda Rajapaksa's speech in Parliament in May 2009.
ii. The Office of the Governors of the Provinces will be abolished and their powers and functions shall be performed by the Head of State.
iii. The Member who commands the majority of a Provincial Council shall be appointed as the Chief Minister and the Leader of the political party which has secured the next highest number of seats shall be appointed as the Deputy Chief Minister.
iv. The Boards of Ministers of the Provincial Councils will be appointed proportionately to the votes polled by the respective political parties in such Council.

05. Judiciary
------------------
i. There shall be an independent and separate Constitutional Court which shall be solely responsible for inter-alia the interpretation of the Constitution and the examination of the constitutionality of Bills and its decisions are final and conclusive. The Executive and the Legislature are bound to follow the decisions of the Constitutional Court.
ii. The tenure, salaries, allowances and privileges of all the judicial officers shall be guaranteed. In the event of any impeachment against Justices of Superior Courts, the Constitutional Court is empowered to investigate into the charges leveled against such Justices, in compliance with the Commonwealth principles (Latimer House Declaration).
iii. The Constitutional Court shall be empowered to hear and determine Parliamentary Election Petitions and there shall be a fixed time period within which the cases are to be concluded.

06. Good Governance
-------------------------
i. Independent Election Commission, Independent Police Commission, Independent Public Service Commission, Independent Judicial Service Commission and Independent Anti-Corruption Agency would be set-up as a matter of utmost priority.
ii. All elections shall be conducted by the Independent Election Commission which shall have the powers to issue directions to all agencies involved in the election process including both State and Private media.
iii. The State will promote and strengthen measures to prevent and combat corruption efficiently and effectively. The institutions of government will promote integrity, accountability and proper management of public affairs, public property and public resources.
iv. A new anti-corruption law will be enacted to give effect to the United Nations Convention on Corruption.
v. There shall be codes of ethics for Parliamentarians, Members of the Council of State, Justices of the Constitutional Courts, Superior Courts, Members of the Judiciary and all other elected Members of the Provincial Councils and Local bodies in accordance with international criteria.
vi. Anti-Corruption Agency law shall include Bribery and Corruptions in the private sector and shall apply retrospectively.
vii. Parliamentary Oversight Committees such as Committee on Public Enterprises (COPE) and Public Accounts Committee (PAC) would be strengthened and Parliament shall take steps to ensure that their recommendations when approved by Parliament are implemented.
viii. There shall be an independent secretariat with a data bank to facilitate investigations by COPE and PAC and they shall be empowered to examine the estimates of annual budgetary allocations before annual budgets are presented.
ix. Any project or investment or contract exceeding the value of Rupees One Billion shall be examined by a specially constituted Select Committee of Parliament.

07. Participatory Democracy

Women's Rights:
i. There shall be an allocation of 25% for women's participation in Provincial Councils and Local Government Institutions.
ii. There shall be a Women's Chamber representing all strata of women from all over the country to deal with the diverse women's interests. The Women's Chamber shall be an instrument of deliberative democracy to uphold and enforce women's rights. The Chamber will also exercise other powers vested by Parliament.
Community Council:
iii. With a view to establishing participatory democracy and building national reconciliation, there shall be community based Councils in each Grama Sevaka Division which are obliged to perform and function on apolitical basis.

* Within 6 months after the formation of a government by the United National Party, the draft constitution will be submitted for the approval of the people at a referendum. This will be the first Constitution to be adopted by the people of this country.
