(Lanka-e-News- 24.March.2021, 6.00PM) Resolution 40/1 on Human Rights, Reconciliation and Accountability in Sri Lanka' submitted to the United Nations Human Rights Council about Sri Lanka, which allows anyone to be prosecuted in any country for war crimes or serious human rights abuses in Sri Lanka. It was passed by a double votes yesterday(23).
22 member states voted in favour of the resolution, 11 against the resolutions and 14 abstained from voting.
Regional countries such as India, Nepal and Japan abstained from voting. Regional countries such as Pakistan and Bangladesh voted against the resolution. Other countries that voted against were China, Russia, Cuba, Eritrea, Bolivia, the Philippines, Somalia, Uzbekistan and Venezuela. Rajapaksa ally Ukraine also voted in favour of the resolution against the Gota regime. The 22 countries that voted in favor were England, France, Germany, Italy, the Netherlands, Poland, Denmark, Austria, Armenia, Argentina, Czechoslovakia, Brazil, Bulgaria, South Korea, Ukraine, Uruguay, Mexico, Marshall Islands, Malawi, Fiji, Ivory Coast and Bahamas. In the resolution that defeated Sri Lanka a year ago, Sri Lanka had 12 votes in favour, but this time it has been reduced to one.
The gruesome Gota government of Sri Lanka worked hard to defeat this resolution and hoped to defeat it, especially with the help of Muslim countries.

The most important elements of this resolution are the following responsibilities of the Office of the High Commissioner for Human Rights.
“Recognizes the importance of preserving and analysing evidence relating to violations and abuses of human rights and related crimes in Sri Lanka with a view to advancing accountability, and decides to strengthen in this regard the capacity of the Office of the High Commissioner to collect, consolidate, analyse and preserve information and evidence and to develop possible strategies for future accountability processes for gross violations of human rights or serious violations of international humanitarian law in Sri Lanka, to advocate for victims and survivors, and to support relevant judicial and other proceedings, including in Member States, with competent jurisdiction”
Accordingly, a special unit will be set up in the office of the High Commissioner, which will include lawyers. It will receive a $ 2.8 million budget over the next 22 months. This unit will provide information needed to prosecute anyone in any country for war crimes or serious human rights abuses in Sri Lanka.
The resolution also recommends that the Commissioner for Human Rights submit three reports within the next 22 months to conduct a regular inquiry into the human rights situation in Sri Lanka.
This is an unprecedented development. This shows the recognition of the world community that the human rights situation in Sri Lanka is deteriorating.
Requests the Office of the High Commissioner to enhance its monitoring and reporting on the situation of human rights in Sri Lanka, including on progress in reconciliation and accountability, and to present an oral update to the Human Rights Council at its 48th session, and a written update at its 49th session and a comprehensive report that includes further options for advancing accountability at its 51st session, both to be discussed in the context of interactive dialogue.
Government's responsibilities..
Responsibilities assigned to the Gotabaya regime Meanwhile, the Sri Lankan government has a number of responsibilities that will be investigated by those reports. They are:
9. Calls upon the Government of Sri Lanka to ensure the prompt, thorough and impartial investigation and, if warranted, prosecution of all alleged crimes relating to human rights violations and serious violations of international humanitarian law, including for longstanding emblematic cases.
10. Also calls upon the Government of Sri Lanka to ensure the effective and independent functioning of the Human Rights Commission of Sri Lanka, the Office on Missing Persons and the Office for Reparations to deliver on their respective mandates as established.
11. Further calls upon the Government of Sri Lanka to protect civil society actors, including human rights defenders, to investigate any attacks and to ensure a safe and enabling environment in which civil society can operate free from hindrance, surveillance, insecurity and threat of reprisals.
12. Requests the Government of Sri Lanka to review the Prevention of Terrorism Act, and to ensure that any legislation on combating terrorism complies fully with the State’s international human rights and humanitarian law obligations.
13. Urges the Government of Sri Lanka to foster freedom of religion or belief and pluralism by promoting the ability of all religious communities to manifest their religion, and to contribute openly and on an equal footing to society.
14. Encourages the Government of Sri Lanka to continue to cooperate with the special procedures of the Human Rights Council, including by responding formally to outstanding requests from them.
Gota regime has completely ignored this...
The Bestial Gota government has already stated that it will completely ignore this resolution, and under such circumstances, a tougher resolution is likely to be tabled in September.
The resolution does not impose economic sanctions on Gota regime. Often such measures are taken by individual countries.

As long as the Rajapaksa governments lasted, the Sri Lankan government suffered defeats at the UN Human Rights Council in 2012, 2013 and 2014. Now it's the same situation has come again.
What has been defeated in Geneva now is the narrow-minded racism used by the Rajapaksas to come to power. Due of this ideology, the Rajapakse government in March 2020 kicked off the Sri Lankan government's agreements with the Human Rights Council, in other words, the international human rights community. Exactly one year later, the international human rights community has responded.
Idiotic statements of Kolambage and Chandraprema..
A day before the vote on the resolution on Sri Lanka, pro government's Lake House said the situation is favaourable to Sri Lanka so much so that Gotabhaya Rajapakse's foreign secretary, Admiral Colombage, said India had promised Sri Lanka that it would oppose the resolution. The result was that all the major political parties in Tamil Nadu immediately sent a letter to Prime Minister Narendra Modi quoting Colombo's statement. The letter called for a vote in favour of the resolution.
Sri Lankan Ambassador to Geneva Chandaraprema made even more short sighted statements. His articles in The Island are now being read at the Human Rights Council as the position of the Sri Lankan government. He continued to attack not only the West but also the Allies of the United States, India, Japan and Australia, known as the 'Quad'. Perhaps he feared that those countries would oppose the resolution for fear of his attacks.
Even more, Sri Lanka's ambassador to Geneva, Chandraprama, sought to attack the entire UN system. He argued that the High Commissioner is doing something beyond her mandate. Those arguments flowed out like raindrops on a lotus leaf.
At the very least, the ambassador failed to present any steps that his governments effort to protect human rights. It convinced member states that the Rajapakse government did not have such a program.
Wicked friends of the Rajapaksa government..
During the council debates, the Rajapakse government introduced to the world, its allied countries such as North Korea, Eritrea, Venezuela and Egypt which currently have some of the worst dictatorships. A country with such friends hardly needs enemies because then a hostile attitude will automatically arise.
South Korea, which normally abstains from voting, voted in favour of the resolution this time. Some of the Asian countries the Rajapakse government received support only from Pakistan, Bangladesh and the Philippines. Philippine President Duterte who publicly admitted that he shot and killed a suspect in the air is also a close friend of the Rajapaksa regime today.
Before the vote, Cuba, Pakistan, China, Venezuela and Russia spoke in support of the resolution on Sri Lanka. Out of these countries, only Pakistan and Russia have nominal or parliamentary democracies. But in both cases, the real power lies with the military.
Eleven countries that voted in favor of the Rajapakse government were China, Russia, Cuba, Venezuela, Somalia, Pakistan, Bangladesh, Uzbekistan, the Philippines, Bolivia, and Eritrea. Looking at these countries, it appears that most of the Rajapakse government's allies are dictators.
In fact, Rajapakse's foreign policy is not non-aligned. It is an evil policy associated with dictators. It was that evil policy that was defeated in Geneva.
International Voice for the Human Rights of our People..
This resolution is not against Sri Lanka. This is an international voice raised for the human rights of the people of Sri Lanka. Two days before the motion was debated, Gotabhaya Rajapaksa said he knew how to teach lessons to the media who does not oblige him. There is no difference between that voice and the insulting mocking voice “who is Lasantha .. .. .?”
On the same day that the World Human Rights Council passed a resolution against the Rajapakse government in support of media freedom and the rights of journalists in Sri Lanka, it was a historic surprise that six of Sri Lanka's leading media organizations issued a statement against Gotabhaya Rajapakse's media harassment.
The prediction made by the Human Rights Commissioner in early February about the repressive politics to take place in Sri Lanka is already coming true. Given the anti-human rights measures unleashed by the Rajapakse government in March, which held four rounds of discussions on the Sri Lanka resolution, this prediction seems realistic. But the Sri Lankan government continued to say that those predictions were wrong.
The Rajapakse government and its politics cannot comprehend the world politics displayed in Geneva. They will continue to embrace fierce dictators. In the next two years, Sri Lanka will become more internationally isolated. The consequences will be felt not by the Rajapaksa family but by the ordinary people of the country.

ශ්රී ලංකාව පිළිබඳ යෝජනාව ඡන්ද විමසීමට ලක්කිරීමට දිනකට පෙර අන්ඩුවේ ලේක්හවුස් හොරණෑ කරුවන් කීවේ තත්වය ශ්රී ලංකා ආන්ඩුවට වාසිදායක වී ඇති බවයි. ඒ කොතෙක්ද යත් ගෝඨාභය රාජපක්ෂගේ විදේශ ලේකම් අද්මිරාල් කොළඹගේ ඉන්දියාව යෝජනාවට විරුද්ධවන බවට ශ්රී ලංකාවට පොරොන්දුවක් දී ඇතැයි කීවේ ය. එහි ප්රතිපලය වුයේ තමිල්නාඩුවෙහි ප්රධාන පෙළෙහි සියළුම දේශපාලන පක්ෂ වහාම කොළඹගේ ප්රකාශය සඳහන් කරමින් අගමැති නරේන්ද්ර මෝඩිට ලිපියක් යැවීමය. එම ලිපිය මගින් යෝජනාවට පක්ෂව ඡන්දය දෙන ලෙස ඉල්ලා තිබුණි.

ඊටත් වඩා ජිනීවා හි ශ්රී ලංකා තානාපති චන්ද්රප්රේම උත්සාහ කළේ සමස්ත එක්සත් ජාතීන්ගේ ක්රමයටම පහර ගැසීමටය. එමෙන්ම මහ කොමසාරිස්වරිය තමන්ට අයත් නැති දේ කරන බවට තර්ක ගෙන ඒම ය. එම තර්ක නෙළුම් කොළයකට වට වැහි බිඳු මෙන් පිටතට ගලා ගියේය.

කවුන්සිලයේ පැවැති විවාදයන්හිදී රාජපක්ෂ ආන්ඩුව තමන්ගේ මිතුරන් ලෙස ලෝකයාට හඳුන්වා දුන්නේ වර්ථමානයෙහි දරුණුතම ඒකාධිපති ආන්ඩු පවතින උතුරු කොරියාව, එරිත්රියාව, වෙනිසියුලාව, ඊජිප්තුව වැනි රටවල්ය. එවැනි මිතුරන් සිටින රටකට සතුරන් අවශ්ය නැති තරම්ය. මන්ද යත් එවිට ඉබේම සතුරු ආකල්පයක් ඇතිවන නිසා ය.
සාමාන්යයෙන් ඡන්දය දීමෙන් වැළකී සිටින දකුණු කොරියාව මෙවර යොජනාවට පක්ෂව ඡන්දය දුන්නේය. ආසියනු රටවලින් රාජපක්ෂ ආන්ඩුවට සහාය ලැබුණේ පකිස්තානය, බංගලිදේශය සහ පිලීපීනය යන රටවලින් පමණි. තමන් විසින්ම සැකකරුවෙකුට ගුවනේ දී වෙඩි තබා මරා දැමූ බව ප්රසිද්ධියේ පිළිගත් පිලිපීන ජනාධිපති දුතර්තේ ද අද රාජපක්ෂ පාලනයේ ගජ මිතුරෙකි.
ශ්රී ලංකාව පිලිබඳ යෝජනාවට පක්ෂ ඡන්දය විමසීමට පෙර කතා කළේ කියුබාව, පකිස්ථානය, චීනය, වෙනිසියුලාව සහ රුසියාව යන රටවල්ය. මෙම රටවල් අතරින් නාමික හෝ පාර්ලිමේන්තු ප්රජාතන්ත්රවාදයක් පවතින්නේ පකිස්තානයේ සහ රුසියාවේ පමණි. නමුත් එම රටවල් දෙකෙහි ද ඇත්ත බලය දරන්නේ යුද හමුදාවන්ය.
රාජපක්ෂ ආන්ඩුවට පක්ෂව ඡන්දය ප්රකාශ කළ රටවල් 11, එනම් චීනය, රුසියාව, කියුබාව, වෙනිසියුලාව, සෝමාලියාව, පකිස්තානය, බංගලිදේශය, උස්බෙකිස්තානය, පිලිපීනය, බොලිවියාව, සහ එරිත්රියාව යන රටවල් දෙස බලන විට පෙනී යන්නේ රාජපක්ෂ ආන්ඩුවේ මිතුරන් වැඩි දෙනෙක් ඒකාධිපතියන් බවය.

මේ යෝජනාව ශ්රී ලංකාවට විරුද්ධ යෝජනාවක් නොවේ. ශ්රී ලංකා ජනයාගේ මානව හිමිකම් වෙනුවෙන් නැගෙන අන්තර් ජාතික හඬකි. යෝජනාව විවාදයට ගැනීමට දෙදිනකට පෙර ගෝඨාභය රාජපක්ෂ කියා සිටියේ තමන්ට ඇහුම්කන් නොදෙන ජනමාධ්යන්ට පාඩම් ඉගැන්වීමට තමන් දන්නා බවයි. ඒ හඬ සහ ලසන්ත කියන්නේ කව්දැයි අපහාසාත්මක කොක්හඬ ළෑමකින් ඇසූ හඬ අතර වෙනසක් නැත.

(Lanka-e-News- 24.March.2021, 10.20PM) The United Nations Human Rights Council has been given a mandate to collect and preserve information and evidence of crimes related to Sri Lanka's 37-year long civil war that ended in 2009.
The 47-member council on Tuesday adopted a resolution on Tuesday, brought by Britain on behalf of a group of countries, boosting UN rights chief, Michelle Bachelet’s staff and powers, with a view to future prosecutions.
22 countries voted in favour of the text, 11 opposed and 14 abstained, including Sri Lanka’s neighbours, India and Nepal and most Muslim majority countries, except for Pakistan, Bangladesh and Uzbekistan, who voted against the motion.
‘Deteriorating situation’
In the resolution the Human Rights Council expressed "deep concern" at the “deteriorating situation" in Sri Lanka, and criticised the erosion of judicial independence, marginalisation of minorities and impunity.
The text pointed to trends emerging over the past year, which according to Elisabeth Tichy-Fisslberger, speaking on behalf of the European Union, represent clear early “warning signs of a deteriorating human rights situation in Sri Lanka”
In his introductory comments, UK Representative to the UN in Geneva, Julian Braithwaite, warned of trends which “threaten to reverse the limited gains made in recent years and risked the recurrence of policies and practices that gave rise to the grave violations of the past.”
Tichy-Fisslberger highlighted the “accelerating militarisation of civilian government functions, "the erosion of the independence of the judiciary", and "increased marginalisation" of Tamil and Muslim minorities, which has been “exacerbated” by the island's response to the COVID-19 pandemic, such as the reported prevention of Muslims, and members of other religions, from practicing their own religious burial rites.
Terror law reform
The resolution also called on the Sri Lankan government to revise the law on the prevention of terrorism which rights groups have warned is being used as a weapon targeting dissidents and minorities in the country.
Under the PTA, it is permitted to detain anyone suspected of causing "acts of violence or religious, racial or communal disharmony”.
Representative for the Philippines, Evan P. Garcia, said the text was “driven by simplistic generalisations of complex conditions on the ground”, whilst Pakistan’s spokesperson, Khalil-ur-Rahman Hashmi argued that the draft resolution “fails to acknowledge the long struggle of the Sri Lankan people and government against LTTE (Liberation Tigers of Tamil Eelam),” and “shies away from a call for accountability of the LTTE and its sponsors and financiers”.
Sri Lanka's ambassador, C.A. Chandraprema, rejected the text as "unhelpful and divisive”. He argued it would “polarise Sri Lankan society and adversely affect economic development, peace and harmony.”

(Lanka-e-News- 24.March.2021, 9.00PM) The UN Human Rights Council (UNHRC) resolution “Promoting reconciliation, accountability and human rights in Sri Lanka” was adopted with 22 members of the council voting in favour of the resolution, 11 members voting against it and 14 members abstaining. The passing of the resolution marks the strongest action ever taken by the UNHRC regarding the human rights violations by Sri Lanka, calling for an extensive series of actions for correcting past wrongs. It also recognises the deteriorating human rights situation in Sri Lanka over the past year, which has warning signs for the future, including accelerating the militarization of civilian government functions, the erosion of the independence of the judiciary and key institutions responsible for the promotion and the protection of human rights and ongoing impunity and political obstruction of accountability for crimes and human rights violations in emblematic cases.
The resolution entrusts the Office of the High Commissioner for Human Rights (OHCHR) to collect and preserve evidence on serious human rights violations and lays down reporting timelines.
The resolution “Requests the Office of the High Commissioner to enhance its monitoring and reporting on the situation of human rights, including on progress in reconciliation and accountability, and to present an oral update to the HRC at its 48th session, as well as a written update at its 49th session and a comprehensive report that includes further options for advancing accountability at its 51st session, both to be discussed in the context of an interactive dialogue.”
An allocation of $2.8 Million was also assigned for the implementation of the resolution.

The resolution is based on a strategy aimed at preventing grave human rights violations. For many years Sri Lanka has successfully evaded taking responsibility for dealing with the violations that have been committed in the country. The present government took up the position of opposing virtually any collaborative efforts in dealing with these problems. Thus, this new resolution marks the beginning of a firm international intervention aimed at protecting the rights of the Sri Lankan people and paves the way for greater respect for the rule of law and international law.
The resolution comes at a time where there is almost complete consensus among people that something has gone radically wrong in Sri Lanka in terms of its political system and administrative systems, including the administration of justice. There are common concerns that the country is on the verge of an unprecedented economic, political and social crisis.
