UNHR Commissioner Navi Pillay report on SL herein - omits ‘final phase of war’ : only beasts and brutes would oppose


(Lanka-e-News-26.Feb.2014, 9.30PM) A true copy of the edited correct report of US human rights Commissioner Ms. Navaneethan Pillay on Sri Lanka (SL) to be tabled at the Geneva human rights sessions to be held in two weeks time was officially made public by the Commission day before yesterday. In its amended report the omission of ‘war’s final phase’ is something most noteworthy.

Main de tracteurs CICR a distribué parmi les favoris de Namal

Il est signalé que certains tracteurs à deux roues dont le Comité international de la Croix-Rouge (CICR) devrait distribuer de Mullaittivu et Districts Vavunia auraient été distribués parmi les personnes de son choix par le député Namal Rajapakse qui ont assisté à la cérémonie avec un groupe de membres de l'UPFA , de passer outre la liste des bénéficiaires préparé par le CICR.

La cérémonie avait été organisée par Mme Maryse Limonar, chef du Comité international de la Croix-Rouge (CICR) à Vavuniya à distribuer 400 tracteurs main parmi les villageois dans les districts de Vavuniya et Mullattivu. Une liste des bénéficiaires a également été préparé par le CICR.

Cependant au milieu de la résistance des représentants du CICR, un groupe de députés dont Namal Rajapaksa, Manusha Nanayakkara, Saranatha Basnayake et le Sri Ranga a distribué les tracteurs de leur choix par la force. En conséquence Mme Maryse Limonar avait marché à l'arrière d'un véhicule du CICR et s'écria qui ne pouvaient pas cacher ses sentiments.

High Commissioner Navi Pillay report on Sri Lanka leaked: international inquiry mechanism recommended: Pillay’s bombshell report corners Rajapaksa regime

(Lanka-e-News-17.Feb.2014, 2.30PM) A damning 20-page report from United Nations Human Rights High Commissioner Navi Pillay became the subject of close scrutiny by the UPFA Government this week. Pillay’s office urged the Government, as is the practice, to respond to the contents of this 74-point report — the precursor to the United States backed latest resolution on Sri Lanka next month — within a week. The External Affairs Ministry (EAM), which co-ordinated the point by point answers converting it to a formal document kept to the deadline which was last Wednesday (February 12).
It was sent to Ravinatha Ariyasinha, Sri Lanka’s Permanent Representative at the United Nations in Geneva, for onward transmission. The Pillay report too had earlier been channelled through him to the Government in Colombo. It will be made public by the Human Rights Council just days before the 25th sessions which begin on March 3 or in less than two weeks.

This report, a copy of which was seen by the Sunday Times, has made recommendations both to the 25th sessions of the UN Human Rights Council as well as the Government of Sri Lanka. To the UNHRC, it recommends, that it should “establish an international inquiry mechanism to further investigate the alleged violations of international human rights and humanitarian law and monitor any domestic accountability process. OHCHR (Office of the High Commissioner for Human Rights) stands ready to assist such a process.”

Here is what the Pillay report calls upon the Government of Sri Lanka to carry out:

(a) Finalise laws dealing with incitement to hatred, witness and victim protection, the right to information, the criminalization of enforced disappearances, in line with international standards, and revise existing laws to bring them into line with International Human Rights Law;
(b) Repeal of the Prevention of Terrorism Act and lift the regulations promulgated under it which allows for arbitrary detention;
(c) Arrest, prosecute and punish alleged perpetrators of attacks on minority communities, media and human rights defenders, and ensure protection of victims;
(d) Undertake independent and credible criminal and forensic investigations with international assistance into all alleged violations of human rights and humanitarian law, including recently discovered mass graves;
(e) Establish a truth seeking mechanism and national reparations policy in line with international standards as an integral part of a more comprehensive and inclusive approach to transitional justice;
(f) Broaden the scope and tenure of the Commission on Disappearances to encompass cases from all parts of the island and all periods of the history of disappearances. Ensure an effective public information campaign and provide sufficient time to hear and record all petitioners who wish to submit complaints;
(g) Publish the final report of the military courts of inquiry, presidential commission of inquiry 2006 and more recent commissions of inquiry to allow the evidence gathered to be evaluated;
(h) Take further steps in demilitarization, and initiate a meaningful and transparent reduction of the military presence to peacetime levels, which would require a clear timeline for demobilisation, disarmament and disengagement from activities that are meant to be civilian;
(i) Engage civil society and minority community representatives more fully in an inclusive and consultative process to support implementation of the LLRC recommendations;
(j) Implement the LLRC recommendation for a national day of commemoration, allow all citizens their right to hold individual or group commemorations, and hold national consultations on the design of appropriate memorialisation for the victims of the war;
(k) Give positive consideration to the offers of technical assistance made by the High Commissioner for Human Rights;
(l) Invite special procedure mandate holders with outstanding requests to visit the country in 2014, particularly the Working group on Enforced and Involuntary Disappearances and the Independent Expert on Minority Issues.

Among other matters, Pillay says that “new evidence — including witness testimony, video and photographic material — continues to emerge on what took place in the final stages of the armed conflict. Human remains also continue to be discovered, for instance in Matale in November 2012 and Mannar in December 2013.” She adds: “As the emblematic cases highlighted above show, national mechanisms have consistently failed to establish the truth and achieve justice. The High Commissioner believes this can no longer be explained as a function of time or technical capacity, but that it is fundamentally a question of political will.

The Secretary-General’s PoE (Panel of Experts) and initiatives by international non-governmental organisations have shown that witnesses are willing to come forward to testify to international inquiry mechanisms which they trust and which can guarantee their protection. For this reason, the High Commissioner remains convinced that an independent, international inquiry would play a positive role in eliciting new information and establishing the truth where domestic inquiry mechanisms have failed. In the absence of a credible national process, she believes the international community has a duty to take further steps which will advance the right to truth for all in Sri Lanka and create further opportunities for justice, accountability and redress.

“The High Commissioner reiterates concern about the continuing trend of attacks on freedom of expression, peaceful assembly and association, particularly against human rights defenders, journalists and families of victims; the rising levels of religious intolerances; and continued militarisation which continues to undermine the environment where accountability and reconciliation can be achieved. She therefore reiterates and updates the recommendations made in her previous report to the Human Rights Council, most of which remain unimplemented.” Diplomatic sources say the Pillay report will form the basis on which the US resolution would be finally worded. That is to make clear that their resolution has been further complemented by the outcome of the UN Human Rights Commissioner’s findings.

One of the important elements in the Human Rights High Commissioner’s report to the Human Rights Council, besides the call for an international inquiry, is that there should be no amnesty for those found guilty of war crimes if a truth seeking mechanism is established. The Government has looked at the South African model for such a purpose and wanted to set up a Truth and Reconciliation Commission.

Even two year commemoration of death of murdered fisherman Antony obstructed by govt.


(Lanka-e-News-17.Feb.2014, 5.30PM) While the joint national fisheries activity committee has organized a series of demonstrations Island wide to mark the second death anniversary of the murder of Antony , a father of two who was killed when he participated in a protest at Chilaw two years ago against the raising of fuel prices unreasonably by the government , the latter according to reports reaching Lanka e news is hampering and impeding that impending demonstration.

The demonstrations are hold in the towns of Jaffna, Potuvil, Galle and Chilaw, on 15th. but it is learnt that already the police and the forces are creating undue obstacles and hindrances against the organization of these demonstrations.

The residents in the camps of Jaffna have specially been met and told that within three months they will be provided with homes , and therefore not to participate in the protests. A bus load of people who were traveling to Jaffna for the protests have also been sent back . The people of Mullikulam who were trying to travel were also intimidated and threatened that if they do go , their Van would be set on fire .

Two bus drivers and an individual had also been separately threatened with death via the same phone number 072 6998507 when they were scheduled to transport people from Mannar to Jaffna.
In addition, people of Pottuvil who had similarly arranged to travel were summoned to the police and threatened against participating in the protests .

President Rajapaksa urged to halt post-election crackdown on media RSF

Reporters Without Borders appealed today to President Mahinda Rajapaksa

Two days after he was declared the winner of this week’s election, Reporters Without Borders appealed today to President Mahinda Rajapaksa to put a stop to arrests and intimidation of journalists working for privately-owned and foreign media.

“This wave of post-election violence could cast a lasting stain on the start of President Rajapaksa’s second term and bodes ill for the political climate during the coming years,” said Reporters Without Borders, which highlighted an increase in election violence and censorship in countries such as Iran and Tunisia in its latest press freedom roundup.

Reporters Without Borders also reminds the president of the statements in support of press freedom that he has made on many occasions, including a meeting with a Reporters Without Borders representative in October 2008.

“It is quite normal for journalists and privately-owned media to side with a candidate before and during a democratic election but it is unacceptable for them to the victims of reprisals once the elections are over,” the press freedom organisation added.

Police and unidentified groups have been targeting the media, especially media that supported the leading opposition candidate, Gen. Sarath Fonseka, every since the announcement of the result, which some opposition sectors including Fonseka are disputing. Sri Lanka’s five main journalists’ organisations have issued a joint statement condemning the “post-election media suppression.”

The following serious press freedom violations have been reported:

1. Police today arrested Chandana Sirimalwatta, the editor of Lanka, a newspaper that supports the JVP opposition party, after he responded to a summons for questioning about an article published on 26 January. The president’s brother, defence minister Gotabhaya Rajapaksa, threatened to burn the newspaper down a few days ago.

2. Plain-clothes men using a car with the license plate 32/ 84 32 placed seals yesterday evening over the entrance to the office of the Lankaenews website. Men searched the office earlier in the day. The website itself has been rendered inaccessible for the past few days by the state telecommunications company Sri Lanka Telecom.

3. In an interview for the Colombo-based Daily Mirror newspaper yesterday, Tamil government minister Douglas Devananda threatened the Jaffna-based newspaper Uthayan with unspecified reprisals.

4. Reporter Karin Wenger of the Swiss public radio station DRS is facing possible deportation on 1 February following the withdrawal of her press accreditation. “I had a visa and accreditation that were valid for the election,” she told Reporters Without Borders. “I think this decision is linked to the questions I asked an official during a news conference after the results were announced.” A presidential adviser referred to her insultingly as a “white face.”

5. Ravi Abewikrama, a reporter with state radio broadcaster SLBC was attacked yesterday by one of the station’s officials for criticising the biased election coverage imposed by the head of the station.

6. Soldiers took up position on 26 January around and inside the buildings that house two privately-owned TV stations, Sirasa and Swarnavahini, in Colombo.

7. Soldiers roughed up photographers working for foreign news agencies when they tried to attend a news conference given by Gen. Fonseka yesterday. One was forced to delete the photos on his camera’s memory card. Soldiers also prevented journalists from working freely near a hotel being used by Fonseka the previous day.

Reporters Without Borders finally also urges President Rajapaksa to assign more police officers to the search for political reporter and cartoonist Prageeth Eknaligoda, who has been missing since 24 January. His family has had no news of him since that date.

Elections Commissioner in a disdainful task anxiously erecting the stage for corrupt elections -CAFFE


(Lanka-e-News, April 2, 2010, 11.55AM) Keerthi Tennekoon , media spokesman for The Campaign for free and fair elections (CAFFE) said, the Elections Commissioner by refusing to allow the election monitors to oversee the polling, and barring the monitors of the European Union (EU) from coming is pulling the wool over the people’s eyes in order to conduct a corrupt and fraudulent election. He is not only opening the floodgate for malpractices but is erecting the stage with assiduous ardor for widespread election frauds across the entire country, he added.

Tennekoon told this at a media conference summoned on the 1st to apprise the media on the corruption and malpractices at elections.
Owing to election laws being totally disregarded with posters, cutouts and banners displayed unlawfully among other violation s, holding a free and fair election has become a day dream in SL, he lamented. The Elect. Commissioner is not taking action to exercise his full authority to control violations. Instead of taking action against violations, what he does is issuing notices and delaying corrective action. FM channels of two UPFA candidates are in operation in the Eastern province. But, when the UNP candidate in Puttalam tried to follow suit, he took immediate action to confiscate the equipment.


Throughout the Island there are Assist. Elect. Commisiooners, election officers, Govt. officials and police officers. They have allowed the ruling party candidates to violate the laws at their will and pleasure. On top of this, in Ampara and Jaffna, two Two District Secretaries and two Police officers have become a hindrance to implementing the laws. At Trincomalee, police are employed to protect the illegal cutouts and posters displayed around. At these Districts, Govt. officials are acting more in breach than in obedience of the law, the CAFFE deeply regretted.
