Appointment of alleged war criminal to head of Sri Lanka army ‘deeply troubling’, says UN human rights chief

(Lanka-e-News -21.Aug.2019, 11.30PM) The appointment of Sri Lankan Lieutenant-General Shavendra Silva as Commander of the country’s army is deeply troubling, UN human rights chief Michelle Bachelet said in a statement released on Monday (19), adding that the military leader had been given the role despite “serious allegations of gross violations of international human rights and humanitarian law against him and his troops during the war”.

Lieutenant-General Silva commanded Sri Lanka’s 58th Division during the final stages of the military campaign against the LTTE rebel Liberation Tigers of Tamil Eelam (LTTE) in 2009, commonly known as the Tamil Tigers, and UN investigations have implicated the division in alleged serious violations of international humanitarian and human rights law.

The UN High Commissioner for Human Rights said that “the promotion of Lieutenant-General General Silva severely compromises Sri Lanka’s commitment to promote justice and accountability in the context of Human Rights Council resolution 30/1”, which promotes reconciliation, accountability and human rights in Sri Lanka.

She added that the promotion “undermines reconciliation efforts, particularly in the eyes of victims and survivors who suffered greatly in the war. It also sets back security sector reform, and is likely to impact on Sri Lanka’s ability to continue contributing to UN peacekeeping efforts.”

This is not the first time that Ms. Bachelet has expressed concerns about Lieutenant-General Silva and his role in the Sri Lankan army: in March this year, she described his previous appointment, as Army Chief of Staff, as a “worrying development” in a report to the Human Rights Council.

In March, Ms. Bachelet also warned that there has been “minimal progress” on setting up mechanisms to deal with the worst crimes committed during the conflict during 2009, and called for the establishment of an independent Truth and Reconciliation Commission and a vetting process to remove officers with questionable human rights records.

The Sri Lankan Government declared victory over the LTTE in May 2009, after a conflict that had raged on and off for nearly three decades and killed thousands of people: the final months of fighting before the Sri Lankan Government declared victory over the Tamil Tigers in May, generated concerns about alleged violations of international human rights and humanitarian law.

Norway and Germany have expressed deep concern regarding the Sri Lankan President’s decision to resume executions in the country for drug offenders.

“Norway is deeply concerned that Sri Lanka intends to implement the death penalty, which would put an end to Sri Lanka’s 43-year moratorium on the use of this cruel and irreversible punishment,” the Norwegian Embassy in Colombo said.

The statement said that as recently as December 2018, Sri Lanka was one of 120 countries that voted in favour of a UN General Assembly resolution calling for a moratorium on the use of the death penalty.

“The vote was a tangible sign of the global trend to move away from the use of the death penalty.”

Norway said implementation of the death penalty would negatively affect Sri Lanka’s international reputation and its human rights record.

“Norway strongly opposes all use of the death penalty as a matter of principle. We believe that states have a duty to protect the safety, well-being and human rights of all their citizens.”

“We have communicated our position and raised our concerns regarding this issue at the highest levels of the Sri Lankan Government, and we urge Sri Lanka to refrain from reinstating the death penalty,” the statement said.

Meanwhile the German Commissioner for Human Rights Barbel Kofler has also issued a statement in response to reports that the Sri Lankan President had publically announced that executions were to take place.

“I am extreme
ly concerned by reports that President Sirisena has publically announced that four death sentences are to be carried out,” she said.

She appealed to the Sri Lankan Government to continue to refrain from carrying out executions following a moratorium lasting more than 40 years, to which Sri Lanka itself expressed its commitment as recently as December 2018.

Executions would be a considerable setback along the path towards a reconciled and peaceful society, said the Federal Government Commissioner for Human Rights Policy and Humanitarian Aid at the Federal Foreign Office.

The application of the death penalty damages Sri Lanka’s reputation, its ambitions in the area of human rights and the country as a business location, she stressed.

Issuing a statement, the France government also said it is deeply concerned at the announcement and urged the Sri Lankan authorities to maintain the moratorium on the death penalty.

“A resumption of executions would be inconsistent with the recent commitments made by Sri Lanka, which voted in support of the resolution calling for a universal moratorium on the use of the death penalty during the most recent UN General Assembly session just six months ago, with the justice minister taking part in the 7th World Congress against the Death Penalty in Brussels in February.”

“France reaffirms its opposition to the death penalty everywhere and under all circumstances and encourages Sri Lanka to join the countries that have permanently abolished this inhumane, unjust and ineffective punishment,” the foreign ministry said.

A senior U.S. State Department official warned on Tuesday that Sri Lanka’s appointment of a war veteran accused of serious human rights violations as head of its army could affect U.S. military cooperation and investment in the island nation.

On Monday, Sri Lanka named Shavendra Silva, 55, as the country’s new army chief despite United Nations accusations that he was involved in human rights abuses during the country’s 26-year-long civil war.

The Washington official, speaking to reporters on background, said the appointment would have lasting implications for reconciliation following the brutal conflict, which ended in 2009.

“It is a highly charged political environment in which some political factions feel there is much to be gained by playing the nationalist card,” the official said.

“It is unfortunate that this card is being played through the promotion of a general about whom vivid and well documented human rights violations are on the record. We are deeply troubled.”

Silva is credited with successfully leading an army division against dissident Tamil Tigers in the final phases of the war. Thousands of civilians were killed in the last phases of the armed conflict, including in areas declared by the government to be ‘no fire zones’ that came under sustained army shelling, including hospitals.

Silva, who joined the army in 1984 and was its chief of staff from January, has denied the accusations.

The U.S. official said there would be “limits to what we can do as we develop a stronger military relationship with Sri Lanka if the army chief is a known human rights violator.”

The official also warned of a possible impact to foreign investment.

“There are limits to what foreign investors are willing to take as far as risk if they see a situation that is leading to greater polarization,” the official added.

The official suggested Silva’s new role could also affect a $480 million grant through the U.S. Millennium Challenge Corporation, aimed at modernizing Sri Lanka’s urban transport system and infrastructure. The agreement is awaiting approval by Sri Lanka’s cabinet.

Asked whether Silva’s promotion could affect the MCC investment, under which a country is assessed on its commitment to democracy, the official said: “It will be one factor that will be looked at.”

This appointment undermines Sri Lanka's international reputation and itss commitments to promote justice and accoutability, especially at a time when the need for reconciliation and social unity is paramount.

Canadian High Commission in Colombo also said it was deeply concerned by the appointment of the new Army Commander.

Shavendra Silva’s appointment as the army commander is a test for the international commitment to accountability and reconciliation in Sri Lanka -GTF

(Lanka-e-News- 24.Aug.2019, 3.30PM) The appointment of Shavendra Silva (Silva) as the new Commander of the Sri Lankan army is a deeply troubling development. For the Tamil community, this signals the end of the road for reconciliation efforts from the Sri Lankan Government. For the international community and all those interested in human rights and accountability in Sri Lanka, the message is unambiguous - the country cares very little about their views or potential consequences of its brazen actions.

There are multiples of reports, including those from UN investigations that implicated Silva with war crimes. In fact, Silva symbolised war crimes and crimes against humanity committed by the Sri Lankan armed forces during the last stages of the war. He headed the military’s 58th Division, that was deemed responsible for summarily executing surrendered Tamil militants and their families, shelling hospitals and no-fire zones packed with women, children and elderly refugees, and stopping humanitarian supplies to trapped civilians.

It is a relief that this abominable action by the President of Sri Lanka has received the world-wide condemnation it thoroughly deserves.

UN High Commissioner for Human Rights Michelle Bachelet described the appointment as “deeply troubling” and that Silva was promoted despite “serious allegations of gross violations of international human rights and humanitarian law against him and his troops during the war.” She further stressed that this appointment “severely compromises Sri Lanka’s commitment to promote justice and accountability in the context of Human Rights Council resolution 30/1” and “undermines reconciliation efforts, sets back security sector reform, and is likely to impact on Sri Lanka’s ability to continue contributing to UN peacekeeping efforts."

The Delegation of the European Union, in agreement with the Embassies of Germany, Italy, Netherlands, Norway and Switzerland, and the UK High Commission, issued a joint statement fully sharing Ms Bachelet’s concerns, and adding that “it sends a worrying message to victims and survivors of the war.” Canada expressed its deep concern stating the appointment undermines reconciliation and accountability efforts in Sri Lanka. As per the US Ambassador in Sri Lanka Alaina Teplitz, “the allegations of gross human rights violations against Silva, documented by the United Nations and other organizations, are serious and credible” and that this “undermines Sri Lanka’s international reputation and its commitments to promote justice and accountability.”

A senior US State Department official castigated Sri Lankan leaders for playing nationalistic card at the expense of reconciliation, and was emphatic in stating there are limits to “what we can do as we develop a stronger military relationship with Sri Lanka if the army chief is a known human rights violator" and “what foreign investors are willing to take as far as a risk if they see a situation that is leading to greater polarisation."

Sri Lanka’s actions are not surprising for those who intimately understand its lack of sincerity and commitment to address criminal accountability of its armed forces. In fact, the reluctance of the international community to be forthright on its assessment when Sri Lanka repeatedly failed to deliver on its commitments - which later evolved into a tendency to go along with the charade that Sri Lanka was making progress - has been unhelpful, to say the least. This eventually led to more brazen and rogue-like actions from Sri Lanka, and the latest attempt has pushed the boundary even further and is testing the level of commitment of the international community for war time accountability.

We are dismayed that apart from the political parties and civil society groups representing Tamils, no other Sri Lankan entities - political parties, civil society organisations, media or even the Sri Lankan Human Rights Commission - uttered a word of condemnation. In fact, the noises if any were in praise of the appointment and condemning the countries that expressed disapproval.

We are grateful there are strong and concerted responses from several countries. We call upon all countries that value human rights, accountability and good governance in Sri Lanka, to make their voices heard – strong and loud - now, as well as during the 42nd session of the UNHRC in September. However, what is more important is to match the diplomatic rhetoric with impactful actions. Freezing Sri Lanka’s involvement with UN Peacekeeping Operations and suspending inter-governmental military co-operation, denying travel privileges for those credibly accused of international crimes, enforcing universal jurisdiction and Magnitsky Act sanctions, and withdrawing preferential investments and trade concessions are all options the international community should seriously consider.

It is crunch time for the political leadership and the polity of Sri Lanka – they need to be conscious of, and if need be impressed upon, the fact that there is a price when a country does deviate from accepted international norms. Any further delay in powerfully conveying this message, underpinned by tangible consequences, will only encourage Sri Lanka to take further reckless steps – perhaps completely withdrawing from its UNHRC commitments. Then, the stakes will be higher, and the path to return to normalcy, respectability and reconciliation, could be arduous and perilous.

There is lots of discussions and debate about his American citizenship in the political arena. But what many of us do not realize is that there is a threatening side that Gotabaya’s renouncing of US citizenship does not address.

Immigration and Citizenship Act 1965

Chapter 212 of the US Immigration & Nationality Act, effective from 1965, addresses the rights, responsibilities and legal obligations of individuals who voluntarily give up their citizenship. It will go into great detail and we will cover some of the points that are relevant to us below.

Military Obligations

A citizen of the United States will not be relieved of his or her obligations to the national security and security services of the country only if they have renounced their citizenship. He is bound to maintain his loyalty to America regardless of what ever country’s he lives and whatever citizenship he has obtained. The people of Sri Lanka country must decide how wise it is to make Gotabaya the first citizen of Sri Lanka.

Punishment for previous offenses

Another important point in the above chapter is that American federal law enables law enforcement to act at any time for offenses committed while a former citizen was a citizen of the United States. According to the law, if Gotabaya becomes the President of Sri Lanka and make a decision that US dislikes, the US can falsify him for a case filed in the US and make him dance according to the US. The people of this country must decide how wise it is to make such a Gotabaya as the president of Sri Lanka.

Right to extradition

This is another dangerous aspect of the above American Act. This enables a former citizen of the United States to be taken into custody by the United States at any time for legal or national security reasons. This enables the US to take Gotabhaya Rajapaksa anytime if he deviates from the US agenda and act legally. If such happens what a disgrace it could be for the Sri Lankan nation. If such happens can Sri Lankans declare a war with the US? The people of Sri Lanka should be wise enough whether to make Gotabaya the first citizen of the country.

The US has the war crime proofs of Gota

Gotabaya was one of the worse criminal during the 88/89 JVP insurgency. Gotabaya Rajapaksa is the owner of the largest mass grave found in Matale Sri Lanka. During the war it was then army commander Sarath Fonseka who was responsible for the war in the north and east. Throughout the war Gotabaya has gone to the north only once. Assassin Gota by residing in AC rooms from Colombo did a strange play. He was involved in abductions, extortions ad hunting journalists and reporters. Gota was a hollow warrior who snatched the war victory of the armed forces that sacrificed their lives and named it as Gotas war. It was Gotabaya who disrepute the war victory by indulging in war crimes. Shavendra, bypassing the army commander Fonseka carried out illegal orders of defense secretary Gotabaya. Gotabaya’s crimes are like fire under ashes that US can light up any moment because they have evidence. The people should think how wise it is to make such Gotabaya the first citizen of the country.

The present situation is a great advantage for the US At a time when the Chinese power in the Indian Ocean has skyrocketed with the help of Mahinda and Sirisena, At a time when the US is thinking where to move the US forces from Afghanistan, It is a great profit for the US when puppet like Gota who can dance according to the US tune becomes the president of Sri Lanka. His supporters and party leaders must once again think whether or not the country is in great jeopardy for the sake of political slavery.

How similar Gota gonna enjoy Shri Wicrama Rajasinghe’s picnic to Velur.

The US has completed its plan to install a force that could subvert the Chinese domination of Sri Lanka. At a time when the US is thinking where to expel the US forces in Afghanistan, Gotabaya is a jackpot for the US. Gota’s nose trap is owned by the US. The story is very simple. Although Gota has renounced the US citizenship it is conditional. Either Gota should give what the US demands if not the latter has to pay the interest for the sins committed. When Gota becomes the president he would be taken to Mauritius similar to Sri Wicrama Rajasinghe who was taken to Velur as a prisoner.

If Sajith and his cronies are anti-Rajapaksa, more than mudslinging at his own senior leaders these are the facts that should reveal to the public today.

ආරක්ෂණ වගකීම් (Military Obligations)

"එක්සත් ජනපදයේ පුරවැසියකු සිය පුරවැසිභාවය අත් හල පමණින් රටේ ජාතික ආරක්ෂාවට සහ ආරක්ෂක සේවා සඳහා ඔහුගේ හෝ ඇයගේ ඇති වගකීම් වලින් නිදහස් කරනු නොලැබේ. ඔබ කවදා හෝ රටෙහි පුරවැසියෙක්ව සිටියේ නම්, ඔබ මේ වනවිට කුමන රටක ජීවත් වුවත් කුමන රටක පුරවැසි භාවය දැරුවත්, එක්සත් ජනපදය වෙත ඔබගේ පක්ෂපාතිත්වය පවත්වා ගෙන යාමට ඔබ බැඳී සිටී." එහි දැක්වේ. එවැනි ‌ගෝටාබය ශ්‍රී ලංකාවේ මුල් පුරවැසියා කිරීම කෙතරම් නුවණට හුරුද යන්න රටේ මහජනතාව තීරණය කළ යුතුය.

පෙර වැරදි සඳහා දඬුවම් කිරීම..

උදර්පණ අයිතිය (Right to Extradition)

ඉහත ඇමරිකානු පනතෙහි තවත් භයානක පැත්තකි මේ. ඇමරිකාවේ පෙර පුරවැසියකු ඕනෑම අවස්ථාවක නෛතික හේතුන් මත හෝ ජාතික ආරක්ෂාවට වැදගත් වන හේතුන් මත සිය භාරයට ගෙන එක්සත් ජනපදය වෙත බලහත්කාරයෙන් රැගෙන යාමට මෙයින් අවස්ථාව ලබා දේ. මේ අනුව ගෝටාභය රාජපක්ෂ ඇමරිකානු න්‍යාය පත්‍රයට පිටින් යන ඕනෑම අවස්ථාවක සිය භාරයට ගෙන ඇමරිකාවට ගෙන ගොස් නීත්‍යානුකූලව කටයුතු කිරීමට ඔවුන්ට හැකියාව ලැබේ. එවැනි යමක් සිදු වුවහොත් ‌ගෝටාබය කර තියාගෙන යන සිංහල ‌බෞද්ධයාට පමණක් ‌නොව ශ්‍රී ලාංකික ජාතියටම මොන නව නින්ගිරාවක්ද? ‌මොකද අපේ කට්ටිය ඇමරිකාව සමග යුද ප්‍රකාශ කරන්නද? එවැනි ‌ගෝටාබය ශ්‍රී ලංකාවේ මුල් පුරවැසියා කිරීම කෙතරම් නුවණට හුරුද යන්න රටේ මහජනතාව තීරණය කළ යුතුය.

ගෝටාගේ යුද අපරාධ සාක්කි ඇමරිකාව සතුය..

ගෝටාබය යනු 89 ජවිපේ කැ‍රැල්ල සමයේ සිටි දරුණුතම ජන ඝාතකයෙකි. මාතලෙන් මතුවූ විශාලතම සමූහ මිනී වලේ හිමිකරු ගෝටාබය රාජපක්ෂය. උතුරු නැගෙනහිර යුද්ධය ක‌ෙළේ සරත් ෆොන්සේකාය . යුද්ධය පුරාවටම ගෝටාබය උතුරට ගොස් තිබුනේ එක් වරක් පමනි. ගෝටා නැමති ජනඝාතකයා කොළඹ ඒසී කාමර වලට වී ක‌ෙළේ අමුතුම සෙල්ලමකි. කප්පම් ගැනීම පැහැර ගැනීම මාධ්‍යවේදීන් දඩයම් කිරීම ඔහු‌ගේ ‌'සෙල්ලම්' අතර විය. ත්‍රිවිධ හමුදාව දිවි පුදා ලබා ගත් ජයග්‍රහණයේ පැසසුම් ‌'ගෝටාස් ‌වෝ' කියමින් උදුරා ගත් පුස් රණවිරුවා ඔහුය. යුධ ජයග්‍රහණය නැමති කිරි කලයට යුද අපරාධ නමැති ගොම දැමුවේ ගෝටාබයයි. ශවේන්ද්‍රලා ‌ෆොන්සේකාටත් ‌නොදන්වා ඉටු ‌කෙළේ '‌සෙකට්‍රි‌ගේ' ‌හෙවත් ‌ගෝටාබයගේ නීති විරෝධී නියෝගයන් ය. ගෝටාබය කළ අපරාධ අළුයට ගිනි මෙනි. ඕනෑම මොහොතක ඇමරිකාවට ඒවා පත්තු කළ හැකිය. මන්දයත් සාක්කි ඔවුන් සතුව තිබෙන බැවිනි. එවැනි ‌ගෝටාබය ශ්‍රී ලංකාවේ මුල් පුරවැසියා කිරීම කෙතරම් නුවණට හුරුද යන්න රටේ මහජනතාව තීරණය කළ යුතුය.

රූකඩයෙහි නූල ඇමරිකාව අතේය..

ඇමරිකාවට මේ හිමි වී ඇත්තේ 'දෙන දෙයියෝ ගෙට ගෙනවිත් දෙනවා' හා සමාන වාසියකි. ඉන්දියන් සාගරයේ චීන බලය මහින්ද සහ සිරිසේනගේ පිහිටෙන් අහස උසට ගොස් ඇති මොහොතක ඇෆ්ඝනිස්ථානයෙන් ඉවත් කරන හමුදාව යවන්නේ කොහෙටදැයි අහස පොළොව ගැටලන්න කල්පනා කරමින් සිටින මොහොතක, සිය රූකඩයක් කොට පහසුවෙන් නැටවිය හැකි ගෝටාබය වැන්නෙකු ශ්‍රී ලංකාවේ ජනපති වීම ඇමරිකාවට ස්වීප් එකක් ඇදුනා හා සමානය. දේශපාලන වහල්භාවය සන්තර්පනය කිරීම වෙනුවෙන් රට මේ සා විශාල අවදානමක හෙලනවාද නැද්ද යන්න ඔහුගේ ආධාර කරුවන් සහ පක්ෂයේ නායකයන් නැවත වරක් කල්පනා කළ යුතුය.

Appointing Shavendra Silva as the Chief of Staff of the army is Sri Lanka’s way of thumping its nose at the international community

(Lanka e News - 12.Jan.2019, 11.30PM) The recent appointment of Shavendra Silva (Silva) as the Chief of Staff of the Sri Lankan army has sent shock waves through the Tamil community, and to all those interested in human rights and accountability in Sri Lanka. Such appointment, particularly as Sri Lanka’s human rights record is about to be reviewed in Geneva in March 2019, is a clear message to the international community that the country cares little about its views and the potential consequences of its failures in faithfully implementing the UNHRC resolution 30, 34/1.

Among all the Sri Lankan military officers implicated in war crimes, Silva is perhaps the most well-known. In many ways, he symbolised war crimes and crimes against humanity committed by the Sri Lankan armed forces during the last stages of the war and the extent to which the country is prepared to hide and protect its military from honest scrutiny and accountability.

Brigadier Silva was the General Officer Commanding of the military’s controversial 58th Division that battled the LTTE in the Vanni in the final days of the conflict. There are multiple reports that strongly implicate Silva with war crimes. The UN Panel of Experts Report (2011) alleged that it was in surrendering to his Division that several LTTE members were shot dead (the infamous ‘White Flag Case’).

According to the South Africa based International Truth and Justice Project (ITJP - 2018), eye witnesses placed Silva on site and claim he even shook hands with the LTTE political wing leaders who surrendered on 18 May 2009, only to be summarily executed shortly thereafter. It has called on the Office of the Missing Persons (OMP) to investigate this as the first case if it was serious about criminal accountability for enforced disappearances, and for Major General Silva to be questioned first. Troops under his command were also credibly accused of shelling hospitals and no-fire zone packed with women, children and elderly refugees.

When Silva was appointed as Sri Lanka’s Deputy Permanent Representative to UN in August 2010, it was viewed not just as Sri Lanka’s attempt to give the highest protection to the most notorious of its military officers, but also as a test of the international will with regards to the extent of their commitment in ensuring war time accountability. During his UN tenure, a law suit was filed against Silva by the relatives of Tamil victims in the District Court of the Southern District of New York, which as expected, Silva fended off invoking diplomatic immunity.

Though the original attempts at preventing Silva’s appointment to the UN failed, a consolation of some sorts was achieved when Silva was debarred from participating in meetings of the Special Advisory Group related to UN peace keeping missions of which he was a member representing the Asian group of countries. The chairperson of the Group, Louise Frechette, a former UN Deputy Secretary General, informed Silva that his participation in the Group was ‘inappropriate’ and advised him to keep away from all ‘deliberations’ of the panel.

Despite these setbacks, the rise and rise of Silva in the ranks of the Sri Lankan army continued unabated after his return from New York – first promoted as Adjunct General, Director of Operations and now a General and the army’s Chief of Staff. None of this is surprising, and indeed expected, by those who intimately understand Sri Lanka’s real lack of commitment to address criminal accountability involving its armed forces, particularly those prominent officers often venerated as war heroes despite their despicable record.

The question is how the international community will face up to these challenges when Sri Lanka once again reports its progress on implementing resolution 30, 34/1 in March 2019, when it will have nothing to report on the criminal accountability of its armed forces. The Silva episode must be one important factor when UNHRC member countries decide on appropriate responses and setting up mechanisms to achieve accountability and reconciliation in Sri Lanka for the post March 2019 period.

(Lanka-e-News -29.July.2019, 11.30PM) The people of Sri Lanka must act together to secure democracy, human rights and the rule of law, says the UN Special Rapporteur on the rights to freedom of peaceful assembly and of association, Clément Nyaletsossi Voule.

“At the root of the rights to freedom of peaceful assembly and of association is the ability of people to come together to make their voices heard. It is important that the people of Sri Lanka unite in order to bolster the democratic progress that the country has made so far,” the expert said, presenting a preliminary statement at the end of a visit to the country.

“While Sri Lanka is party to many of the international human rights instruments which have created clear human rights obligations for the State and while legislation has been put in place to largely reflect these obligations, divisions in society represent a threat to them being fully achieved.”

The expert was daunted by the widespread fear of setbacks in the democratic gains expressed by all sectors of society. “It is important that the country’s political leaders do not dismiss people’s desire for freedom, rule of law and democracy and do not undermine the progress that has been hard fought for, particularly in light of the upcoming elections.”

The Sri Lankan constitution protects the rights to both freedom of peaceful assembly and freedom of association. But the Special Rapporteur was made aware of a number of laws whose application jeopardised those rights, including sections of the penal code, the ICCPR Act, as well as the Prevention of Terrorism Act. The Vagrants Ordinance is also used, specifically in targeting LGBTI minorities.

“It has been brought to my attention that these laws are frequently applied in a discriminatory manner against those people organising around specific issues such as disappearances, land rights, livelihood and access to resources, and development projects,” Voule said.

“The Government must equally act to address the root causes of protests, dealing head on with the issues raised by participants in the course of their demonstrations.”

The Special Rapporteur’s visit comes at a critical time for the country, following the devastating terrorist attacks in April and a constitutional crisis late last year. In addition, the current application of emergency regulations has heightened tensions and has made it more difficult for some members of civil society to carry out their activities and assemble peacefully.

Recently, a series of legislative reforms were proposed including changes to the law regulating NGOs and the creation of counter-terrorism and unified employment bills. However, these revisions were met with stark opposition from civil society campaigners, who say that they risk clamping down on existing rights and were created without a sufficiently participatory consultative process.

“Following these objections, I am pleased to say that the relevant Minister withdrew the draft NGO bill, opting instead to permit civil society to create their own draft law for discussion,” Voule said.

Failure to enact comprehensive security sector reform since the devastating and protracted civil war, which ended in 2009, has also made it difficult for civil society to operate. Intelligence frameworks that carry out surveillance of protests and other activities are still in place, and threats and harassment of human rights defenders have also been reported.

“In certain areas of the country, this is reminiscent of past practices and continues to instil fear and deter people from exercising their rights to freedom of assembly and association,” Voule said.

The Special Rapporteur also expressed concern over the growing prevalence of hate speech in the country, which increased notably after the April attacks.

“While legislation is in place to combat hate speech, including under the ICCPR act of 2007, the legislation is not applied with an even hand, and discriminatory and violent rhetoric, particularly by members of the majority community frequently goes unpunished. This is exacerbated by the use of social media to fan the flames of hatred and spread misinformation. This is a serious threat to the existence of a respectful and peaceful dialogue among sectors of society, an essential element for any representative democracy,” Voule said.

During his visit, the UN expert travelled to the North, South and East of Sri Lanka, as well as the capital, Colombo. He met Government officials and representatives of civil society, trade unions and others. He thanks the government for the invitation and the cooperation before and during the visit.

The Special Rapporteur’s conclusions and recommendations will be presented to the UN Human Rights Council in June 2020.

Yesterday, in a political speech, you referred to my father, and your close friend, Lasantha Wickrematunge, who was murdered on 8th January 2009. Responding to a claim by Gotabaya Rajapaksa that as president, he would create an environment without fear, you asked whether Rajapaksa would apologise for my father’s murder and several other gruesome crimes.

Let me put your mind at ease. No. Gotabaya Rajapaksa will never apologise for my father’s murder. In television interviews over the last 10 years, he has made no secret of the fact that he was proud of it. He has made up his mind not to apologise. But have you, Prime Minister? Will you apologise for spending the last four and a half years protecting and cavorting with the man you today call a mass murderer?

From the day my father died, you have invoked his name to win votes. My father’s murder was a prop in the 2015 presidential and parliamentary election campaigns that made you Prime Minister. You brought President Sirisena to power and won control of Parliament for the UNP, all by promising justice for my father’s murder.

As soon as you came to power, your priorities changed. When I met you at Temple Trees in February 2015 to appeal for your support in making sure my father’s killers saw justice, you told me that there were “other priorities” and that justice was “not just about Lasantha.”

I have since seen what these priorities are. The police, which came under the direct purview of your Chief of Staff, did not bring Gotabaya Rajapaksa to justice. Proving the MiG Deal is a critical part of proving why my father was killed. But on your watch, a corrupt officer in charge of the FCID botched the MiG Deal investigation and kept Gotabaya’s name out of it.

Because it is election season, you are publicly attacking him as a killer. But even as you do so, your Chief of Staff Sagala Ratnayake and other ministers are visiting him and spending hours at his residence, your government is allegedly issuing him irregular identity cards and passports and your senior aide and niece is openly promoting Gotabaya Rajapaksa’s campaign propaganda on on social media.

This is the kind of treatment that you and your staff mete out to the people you call murderers. However, whenever the CID needed help with my father’s case, you were nowhere to be seen.

Where were you, Prime Minister, when the army and intelligence services refused to cooperate with the investigation? What did you do when you were told a critical informant against Gotabaya Rajapaksa needed protection? And when my father’s lead murder investigator, Inspector Nishantha Silva, was kicked out of the CID by the President, why did you not lift a finger in protest?

For months now, your Attorney-General has been forcibly shutting down investigations involving Gotabaya Rajapaksa and the Tripoli death squad, covering up their involvement and pressing charges against foot soldiers. Gotabaya Rajapaksa was let off the hook in the Eknaligoda case despite two officers confessing that he personally ordered the abduction. Rajapaksa has not even been questioned about these sworn confessions. Even though Upali Tennakoon was attacked using four motorbikes, only two junior soldiers are being charged. Rajapaksa and the Tripoli team got off scot free. Will you do anything meaningful to seek accountability?

No. Instead, your family and senior staff continue to bond with Gotabaya Rajapaksa, while you blithely call him a murderer in public. If you become President or remain Prime Minister, I am certain that the mysteriously absolute impunity that Gotabaya Rajapaksa has enjoyed on your watch will continue unabated.

Now that the man who boasted about my father’s demise is formally a presidential candidate, I pray that his opponent will be an honest and courageous politician who embodies justice, equal protection under the law and mature, responsible governance. I pray that the candidate who opposes Rajapaksa will not be someone who cuts backroom deals and compromises his principles to ensure his own political survival to the detriment of his party and his country.

There is but one last hope for me and the other survivors and victims of white van era brutality. Gotabaya Rajapaksa must be challenged and defeated by a contender who is committed to delivering justice when in government, and not by someone who exploits victims to win elections and thereafter entertains people he calls murderers at his official residence.

Simply put, if this country remains at your mercy and at the mercy of your new friend, Gotabaya Rajapaksa, then there is no hope that your old friend, my father Lasantha Wickrematunge, will ever receive justice.

Officials wary to probe legality of Gota’s citizenship

Questions have been raised as to how Gotabaya Rajapaksa obtained a passport from the Department of Immigration and Emigration in May omitting an endorsement of his dual-citizen status. Rajapaksa told reporters last week that this passport was proof that he was no longer a dual citizen under Sri Lankan law.

Immigration officials, however, told the Daily FT that persons with dual citizen status are required to make a formal application under the Citizenship Act if they wish to regain regular Sri Lankan citizenship. Rajapaksa had not followed this regular process, they said, but had somehow obtained a passport which did not indicate his dual citizenship status.

Rajapaksa’s passport application, immigration records showed, was received and processed on an urgent basis on 7 May after 3.00 p.m, which is the cut-off time for new applications. Rajapaksa did not appear at the immigration department to be finger-printed, and the passport was issued in a matter of hours under a new National Identity Card (NIC) number not connected to Rajapaksa’s previous NIC or border control records.

The use of a new NIC prevented the immigration computer systems from automatically noting that Rajapaksa was indeed on record as a dual citizen. The manoeuvre may have allowed him, in theory, to bypass the legal process followed by ordinary persons to prove that they are no longer dual citizens.

Dual citizenship, the officials said, is a ‘status’ granted by the Government to former Sri Lankan citizens allowing them to exercise all of the rights of a Sri Lankan citizen. “Unlike regular citizenship, it is a strictly political decision,” the officials said. “The Minister has unquestioned authority to approve, deny or revoke dual citizenship as he determines in the national interest.”

According to Section 19 of the Citizenship Act, the Minister may only grant dual citizenship “if he is satisfied” that doing so “would, in all the circumstances of the case, be in the best interests of Sri Lanka.”

Unlike normal citizens, the Citizenship Act allows the Minister to revoke the status given to dual citizens. Section 19 (7) states that “the Minister may, at any time, revoke” a declaration of dual citizenship status if a dual citizen “has so conducted himself that his continuance as a citizen of Sri Lanka will not be of benefit to Sri Lanka.”

Should a dual citizen wish to become an ordinary Sri Lankan citizen whose status is not subject to revocation, they must apply under the Citizenship Act for a declaration that they are again full Sri Lankan citizens. This again is a decision that is delegated to the Minister for citizenship matters.

According to an affidavit filed by Gotabaya Rajapaksa in the Supreme Court, he returned to Sri Lanka in 2005 in order to assist with his brother’s presidential election campaign. He was an American citizen and not a Sri Lankan citizen at the time. Immigration records indicate that he arrived in Sri Lanka on his American passport with an on-arrival tourist visa in order to campaign for Mahinda Rajapaksa, applying for dual citizenship on Friday, 18 November 2005, the day his brother was sworn in as President of Sri Lanka.

Election records show that Gotabaya Rajapaksa was also a registered elector in Sri Lanka for the electoral list used in the 2005 presidential election, despite not being a citizen or entitled to vote at that election.

An electoral list for Medamulana in Weeraketiya lists ‘Rajapaksa Nandimithra Gotabaya’ as elector number 130 at house number 114. Also registered to vote from that address were candidate ‘Rajapaksa Percy Mahendra’, his wife ‘Rajapaksa Shiranthi’, Gotabaya Rajapaksa’s American citizen wife ‘Rajapaksa Ioma’ and Chamal Rajapaksa.

Alarmingly, investigators were unable to locate any files pertaining to Rajapaksa’s dual citizenship at the Immigration Department. The only records available indicate that he had applied for dual citizenship on 18 November 2005, the day his brother Mahinda Rajapaksa was elected President.

Records show that his application was approved by the Minister on the next working day, Monday, 21 November, despite there having been no Minister yet appointed at that time. Despite a large backlog of applications over several months, Rajapaksa’s was brought to the front of the line.

According to the computer system, while the dual citizenship was granted in November 2005, the data pertaining to Rajapaksa was only entered into the system on 13 January 2014. In such a situation, officials would typically refer to the original paper records or digital scans of them to ascertain the factual position.

However, officials have found that there are no copies of the application, receipt of payment, or the dual citizenship certificate granted to the former Defence Secretary on file at the department. While dual citizens are usually required to present their dual citizenship certificate when obtaining a new passport, immigration records show no sign that Rajapaksa had ever presented a dual citizenship certificate when obtaining a passport.

The standard procedure followed by immigration investigators in situations of this nature, where irregularity is suspected in the issue of a passport, and critical records of dual citizenship appear to be altered or missing, is to send a formal complaint to the Criminal Investigation Department (CID) for further investigation.
However, in this instance, it is learnt that immigration officials have not forwarded information to the CID.

Let’s Boycott President

Sri Lanka have been suffering its worst days ever in its long history (of over 3500 years) since the Organized Coup on 26th October 2018 where the Executive President Violated the Constitution (on which he took oath that he would protect its dignity and will not violate it). He has been continuing to violate the constitution and have been engaging beyond his limits of power entitled to him by the constitution. To cover his first mistake, he has been violating over and over.

Since then, we have been witnessing twisting of tongues by the President which eventually proved that he no longer deemed fit to rule this country. We have been seeing on a daily basis that his speeches are in total contradiction to his previous speeches/promises. He himself symbolically admitted that his speeches are nothing but mere words to appease the Gallery and to seek attention.

As public, we have an obligation to display our dissatisfaction towards his actions over the period since 26th October. We already witnessed Many People are showing their displeasure at the President and his Men. A State Recognition Award for a Highly Appreciable Gentlemen was already returned , Tourism Industry Leader’s Decision to Boycott Awards Ceremony, The refusal of Receiving Awards from those MP’s who support the illegal move by president are good examples.

Therefore, it is high time we, the Citizens of Sri Lanka who honour the Country’s Dignity and respect the Constitution, should also set an example by BOYCOTTING ANY EVENTS OR PROGRAMMES FOR WHICH THE PRESIDENT IS SCHEDULED TO ATTEND” and show our silent displeasure towards his actions thereby teaching a lesson to anyone in the future who may have a motive of violating the Constitution or going against the country’s sovereignty. If a lesson is not taught, then it would pave way for others to follow the same footpath of the president and do things to his own whims and fancy.

THIS ACTION WAS FORCED UPON THE PUBLIC TO TAKE WHICH IS NOT TO TARGET ONE INDIVIDUAL OVER HIS MADNESS, RATHER IT IS TO MAKE A LESSON TO WHOEVER MAY COME TO THAT SEAT IN THE FUTURE.

WE MAY LOSE LITTLE BY DOING THIS BUT WE MUST REMEMBER THAT THERE IS NO GAIN WITHOUT PAIN.

Sri Lankan Politicians as archetypes of destruction - Asian Human Rights Commission

(Lanka-e-News - 16.July.2019, 11.50AM) In the Sri Lankan mind, politicians are thought to be engaged in the destruction of the lives of the people and the foundations of the nation.

In the subconscious or unconscious, this has gone so deep that to speak of them as archetypes in the Jungian sense is no exaggeration at all.

It is commonly said that all 225 members of parliament should be dismissed for the good of the people.

To be an archetype of destruction is worse than being a mere dictator or tyrant. History shows that in the past of many countries there were kings who were basically dictators but who did much for the benefit of the people they ruled over and for the development of the political structures and institutions within which people could achieve peace and protection. A tyrant is essentially a person who, as John Locke pointed out, did not have the common good in this political designs but mostly ruled for their own self interest. Both these categories use power for ends that they were conscious of, for the better or worse for the people.

But to have legislators and rulers that are not even aware of what they are trying to achieve is even worse than being subjected a dictator or a tyrant. Their actions and their speech, whether intentionally or not, are directed towards destroying the better moral and legal foundations of their countries. The worst part of it is that they are often not concerned with any good aims, meaning either good for the nation or for themselves. The self-destructive nature of Sri Lankan politicians was well portrayed in one silly even that people saw on television recently: the so-called debate on the no confidence motion against the government relating to its inability to prevent the events of 23rd April Easter Sunday attacks.

It was a silly debate because none of the speakers were really revealing anything that people have not already known for some time. Specifically, there was information that bombings were going to take place in Sri Lanka by a terrorist group, which would cause serious harm. Beyond this, nobody among the speakers in the debate made any attempt to reveal information about what caused this bombing, how it was organized, how and where the suicide bombers were trained, who brought in the necessary money and other materials into the country to enable the attacks, and what the command responsibility of the state was within such a context in terms of the framework of the rule of law.

In fact, calling it a debate was ludicrous. It was merely a childish play just to hoodwink the people. The movers of the resolution and those who supported it were seeing the 23rd April events as a great opportunity that may allow them to topple the government, with the hope that it would provide opportunities for them to come to power.

On the other hand, the government, instead of revealing and analyzing their own decisions relating to the catastrophic events that happened, and perhaps taking a more confessional approach with concrete plans for the future protection of the people, were engaged in preserving their power. Further, the people in government was also concerned with using the occasion to further the conflict between two groups that are now at loggerheads. This kind of quarrelsome shouting at each other is not a debate.

The idea of a debate has a long history, both in Western culture as well as in the East. When Socrates engaged with the people in the latter part of his life, questioning them and himself about their pretenses and the actual lack of knowledge about the things that they claimed to know about, he was basically pursuing a path that showed, through the revelations in the gaps in existing knowledge, how to delve deep to understand things better.

It is in that spirit that debates began to spread, which gave rise to the whole idea of empiricism as the tool for verifying information to get at something closer to the truth as much as possible. Renee Descartes became the symbol of that kind of investigation wherein every observation was doubted and, by the process of doubting, what was obviously untrue was eliminated, thereby paving the path for something that was true or closer to the truth.

Modern science is founded on this principle, with various schools that developed this basic concept from many different points of view.

Looking for the truth about a catastrophic event is necessary for the very survival of a people. The search for the truth behind such things is therefore vital to the community and also to all the institutions of the state that are functioning in order to achieve a harmonious, peaceful and productive society.

Therefore, it was simply silly to waste that time when people are agonizing to get to the truth. The people’s representatives should not have wasted that time by making a cynical attempt to get some limited advantages for themselves. Such attempts prove that they have, in fact, become an archetype of destruction.

Although the debate was ludicrous, it was an expensive affair. The parliamentary meeting was broadcast to the whole nation, costing a lot of money that was especially wasteful in a country that is so indebted that all its national revenue goes to the payment of loans.

The issue of expenses apart, there is the damage that this kind of “debate” does to the minds of the people’s representatives themselves, as well as to the minds of the people of the country, particularly the young. Young people watching this kind of quarrel don’t learn anything about the art of debating and searching for truth, or about the responsibilities that people owe each other when facing such events that threaten the whole nation.

If this was not a parliamentary debate but a mere teledrama, it is no doubt that many people would stop watching it. It even lacks the elements of a good drama. There is no critical or aesthetic value to this open quarrel, with politicians shouting at each other while knowing that the whole exercise would ultimately produce nothing.

Even though it’s silly and of a very low quality, it was nonetheless a drama, amateur dramatics. It was a drama to use of time, to pretend something was being done when nothing was being done.

When a country’s ruling elites, consisting of both the governing and opposition parties, become archetypes of destruction, what could such a nation produce? Is it a surprise that everything is getting worse, including the country’s indebtedness, its dropping productivity, the contamination of medicine in hospitals and dispensaries, poor quality education and transport, just to mention a few?

When a destructive archetype emerges to the surfaces, it only causes pain. In this case, the whole nation is affected.

It is this situation that, as one prominent journalist said recently, has led the country to a state similar to a volcano close to erupting. It would be more accurate to say that the volcano is already erupting, but that things may get even worse in the time to come.

(Lanka-e-News -12.Aug.2019, 11.30PM) Earlier today, former President Mahinda Rajapaksa announced the presidential candidate for his family’s new political party, the Sri Lanka Podujana Peramuna (SLPP). For weeks he refused to confirm the circulating rumours about who the candidate would be. I have known Mahinda Rajapaksa for many years. We worked together side-by-side in the Sri Lanka Freedom Party (SLFP) under President Kumaratunga. We fought campaigns together and we won elections together. I have served in his Cabinet.

When I left Mahinda Rajapaksa’s government in 2006, he was a different man than I had once known. As President, his priority had become enriching, protecting and empowering his own family, not his country. Once upon a time, he was a true son of the soil, and a man whose heart beat as one with the ordinary citizens of Sri Lanka.

I wondered, after he was defeated in January 2015 by over 400,000 votes, and retreated to Medamulane, whether he had reflected and learnt a lesson from the error of his ways. I wondered if he regretted putting his family in charge of the state machinery and standing idly by as the nation’s coffers were robbed dry, and our journalists were bundled into white vans never to be seen again. I wondered if he regretted buttressing his political position by inciting racial hatred across Sri Lanka, first against Tamils, and later against Muslims.

In October 2018, when he conspired to orchestrate a coup d’état and illegally seize power, I realized that these were not the lessons he learned. The rule of law meant nothing to him. Democracy was only a buzzword to thunder from a stage. When Parliament stood against him, he had his minions try to destroy Parliament. It was only when the courts had the courage to stand up to him that Mahinda Rajapaksa finally aborted his coup and backed down.

Today I realized the terrible truth about what Mahinda Rajapaksa has really learned during his time in opposition. He does not feel that he gave his family too much power. He clearly believes that he did not give his family enough power. He does not feel that his merry men pilfered one too many million rupees or public money. He believes there is more left to milk dry. He does not feel that he terrorized this country too much. He clearly believes that he did not terrorize this country enough. He is not worried that he overly threatened the independence of the judiciary. He believes he should not have allowed any independence in the judiciary at all.

He does not regret the disappearance of Prageeth Eknaligoda, the murder of Lasantha Wickrematunge or the abduction and torture of Keith Noyahr and countless other journalists. He wants any remaining independent journalists to know that if they cross the man who committed those crimes, they will be next.

These are the lessons that Mahinda Rajapaksa has learnt. If not, he would not have announced today as his presidential candidate, a man who is on trial in two courts, one for corruption of over Rs 11 billion, and another for stealing over Rs 33 million in our taxpayer rupees to build a statue of his parents. He would not have announced as his chosen successor the man who has gloated about the murders of journalists, who has jailed real war heroes like Sarath Fonseka, and who has tried to bend the judiciary to his will.

After nearly five years in opposition, if Mahinda Rajapaksa’s message to the people is that one of his brothers should be president, he himself should be prime minister, another brother should be Speaker, a fourth brother put in charge of the economy and his son put in place as his chosen successor, that tells us all we need to know: in the mind of Mahinda Rajapaksa, Sri Lanka, its land and its people are destined to be the private property of the Rajapaksa family.

Sadly, there are many Sri Lankans, whose hatred for certain segments of our country, in particular religious and ethnic minorities, lead them to gravitate towards the vision of the Rajapaksa family. They will gladly be second class citizens in a Rajapaksa family dynasty, so long as Tamils, Muslims, Christians and others are forced to live as third-class citizens. Others will support the Rajapaksas out of greed, or to escape prosecution for the sins of their part.

From an electoral standpoint, it never mattered who the Rajapaksa candidate for president was. That is my feeling about the announcement of Gotabaya Rajapaksa. I am personally ashamed on behalf of my country to have to concede that for the first time in our history, a serious frontrunner for president is an alleged criminal whose very citizenship of this country is in question. But the question never was “will it be a Rajapsaksa?”. No. It was always “which Rajapaksa will it be?”.

Truth be told, the entire family represents thuggery, corruption, deception and a flagrant disdain for democratic values and independent institutions. The candidate is a figurehead. The choice of Gotabaya had nothing to do with trying to win more votes. If at all, such a choice would diminish their electoral prospects among liberal voters and minorities. The “terminator” was chosen for a different reason: to terrify the media, police officers, judges and public servants with a simple message: cross us at your peril.

It is a desperate tactic. It will fail. Politics is a distance runner’s race, not a sprint. The person at the front of the pack in a marathon rarely wins the race. Only amateurs jump up in front. What Mahinda Rajapaksa has done is shown the entire country, many months before an election, what his priorities are, what his assets are, and where his loyalties lie. The answers? Rajapaksas, Rajapaksas and Rajapaksas.

The next president of Sri Lanka will not be Gotabaya Rajapaksa or any Rajapaksa. The next president of this country will not be an alleged criminal who has the blood of countless journalists and innocents on their hands. Our next president will be a Sri Lankan citizen, born in Sri Lanka who never fled this country or swore allegiance to another land. The next president of Sri Lanka will be the person democratically selected by the United National Party and its allies to stand on a platform of democracy, safeguarding the judiciary, public service and other independent institutions and putting ordinary citizens before any family. Our candidate will be the next president of Sri Lanka. Who is our candidate?

He is the man who will unite the forces of transparent, secular, liberal democracy across our country, who will go toe-to-toe with any number of Rajapaksas and their white vans, will rally the people of Sri Lanka against tyranny and oppression, and will win.

මා අවුරුදු ගාණක් තිස්සේ මහින්ද රාජපක්ෂ හොඳින් හඳුනමි. ජනාධිපතිනි කුමාරතුංග යටතේ අපි දෙදෙනා ශ්‍රී ලංකා නිදහස් පක්ෂයේ දී ඉතා සමීපව වැඩකර ඇත්තෙමු. අපි එකාවන්ව එක්ව ඡන්ද ව්‍යපාරවල යෙදී ඇතුවා මෙන්ම ඒවා ජයගෙන ඇත්තෙමු. මා ඔහුගේ කැබිනෙට්ටුවේ සේවය කර ඇත්තෙමි.

2006 දී මා මහින්ද රාජපක්ෂ ආණ්ඩුව අතහැර යනවිට ඔහු මා කලින් දැන සිටියාට වඩා වෙනස් පුද්ගලයෙක් වී සිටියේය. ජනාධිපති වූ පසුව ඔහුගේ ප්‍රමුඛතාවය වූයේ රට නොව සිය පවුල පෝසත්කොට, ආරක්ෂා කොට බලවත් කිරීමයි. එකමත් එක කලක ඔහු මේ රටේ සුනීත පුත්‍රයෙකු වූ අතර ඔහුගේ හදගැස්ම වුණු ජනයාගේ හදගැස්ම හා සමපාත විය.

2015 ජනවාරියේ ලක්ෂ හතරකටත් වඩා වැඩි ඡන්ද ප්‍රමාණයකින් පරාජය වී මැදමුලනට පසුබැසීමෙන් පසු ඔහු සිදු වූ වරද ගැන සිතා බලා ඒවායින් පාඩමක් ඉගෙනගත් බවක් මට නොපෙනේ. රාජ්‍ය යන්ත්‍රණයේ සුක්කානම සිය පවුලේ ඥාතීන්ට බාර දී, ජාතියේ ධන සම්පත් ඔවුන් කොල්ලකද්දී, එමෙන්ම ජනමාධ්‍යවේදීන් සුදුවෑන්වලින් නැවත නොඑන ලෙස කුදලාගෙන යද්දී නිකම් බලා සිටි ඔහු ඒ ගැන පසු තැවෙන්නේ නැද්දැයි මා අසමි. ඔහු සිය දේශපාලන හයිය ගන්නට පළමුව දමිළයන්ට විරුද්ධවත් හා පසුව මුස්ලිම් ජාතිකයන්ට විරුද්ධවත් වෛරය පැතිරවීම ගැන ඔහු පසුතැවෙන්නේ නැද්දැයි අසමි.

2018 ඔක්තෝබරයේ රාජ්‍ය විරෝධී කුමන්ත්‍රණයක් දියත්කොට බලෙන් රාජ්‍ය බලය පැහැරගත් ඔහු තවමත් පාඩම් ඉගෙනගෙන නැති බව මා තේරුම් ගත්තෙමි. නීතියේ ආධිපත්‍ය ඔහුට තුට්ටුවක් නොවටී. ප්‍රජාතන්ත්‍රවාදය ඔහුට අනුව වේදිකාවේ සිට තප්පුලන නිකන්ම වචනයක් පමණි. ඔහුට එරෙහිව පාර්ලිමේන්තුව හඬනැගූ විට ඔහු සිය ඇම්බැට්ටයන් ලවා පාර්ලිමේන්තුව විනාශ කිරීමට තැත් කළේය. අවසානයේ ගරු අධිකරණය නිර්භීතව ඔහුට එරෙහිව තීන්දු දුන් විට මහින්ද රාජපක්ෂ සිය කුමන්ත්‍රණය හකුලාගෙන නිහඬ විය.

මහින්ද රාජපක්ෂ විපක්ෂයේ සිටි කාලය තුළ සැබවින්ම ඉගෙන ගත් දේ පිළිබඳ භයානක සත්‍යය අද මට වැටහුණි. ඔහු තම පවුලට ඕනෑවට වඩා බලයක් ලබා දුන් බව ඔහුට දැනෙන්නේ නැත. ඔහු පැහැදිලිවම විශ්වාස කරන්නේ ඔහු තම පවුලට ප්‍රමාණවත් බලයක් ලබා නොදුන් බවයි. ඔහු තවමත් සිය ප්‍රිය මිතුරු ඥාති සමුදාය මේ රටේ මහජන මුදල් මිලියන ගණනින් පැහැරගත් බවක් පිළිනොගනී. තවතවත් මිරිකා සූරා හප කරන්නට මේ රටේ සාරය තවත් ඉතිරිව ඇති බව ඔහු විශ්වාස කරයි. මේ රට තුළ තමා විසින් අසීමාන්තිකව භීතිය වැපිරූ බවක් ඔහු තවමත් නොපිළිගනී. ඔහු අධිකරණයේ ස්වාධීනත්වයට ඕනෑවට වඩා තර්ජනය කිරීම ගැන ඔහු කනස්සල්ලට පත්ව නැත. ඔහු විශ්වාස කරන්නේ අධිකරණයේ කිසිඳු ස්වාධීනත්වයක් ලබා ගැනීමට ඉඩ නොදිය යුතු බවයි.

ප්‍රගීත් එක්නැලිගොඩ අතුරුදන් කර, ලසන්ත වික්‍රමතුංග මරා දමා, කීත් නොයාර් පැහැරගෙන ගොස් වධ හිංසා කොට තවත් මාධ්‍යවේදීන් විශාල ප්‍රමාණයකට වධදුන් ආකාරය ගැන මහින්ද රාජපක්ෂට පසුතැවීමක් නැත. ඉතිරිව සිටින ස්වාධීන මාධ්‍යවේදීන්ට ඔහු ලබා දෙන පණිවිඩය නම් එම අපරාධ කළ පුද්ගලයාට මඟ හරස් කළොත් ඔවුන්ට ද එම ඉරණම නියත බවයි.

මහින්ද රාජපක්ෂ උගෙන ඇති පාඩම් එලෙසය. එසේ නොවුවා නම් ඔහු අද දින අධිකරණ දෙකක ඇසෙන නඩු දෙකක විත්තිකරු වී සිටින පුද්ගලයෙකු සිය ජනාධිපති අපේක්ෂකයා ලෙස නම් කරන්නේ නැත. එම නඩු දෙකෙහි චෝදනා නම්, එකක් රුපියල් බිලියන එකොළහක මූල්‍ය දූෂණයකි. අනික සිය දෙමව්පියන්ගේ පිළිම ඇඹීමට බදු ගෙවන ජනතාවගේ මුදලින් රුපියල් බිලියන තිස්හතක් හොරා කෑමය. එසේ නොවුනිනම් මාධ්‍යවේදීන් මරා දැමීම ගැන කාලකන්ණි සන්තෝෂයක් ලබා සැබෑ යුධ වීරයෙකු වන සරත් ෆොන්සේකා මහතාව දඟගෙයි දැමීමෙන් සිය මනාපයට අනුව අධිකරණය නම්මවා ගැනීමට තැත් කළ පුද්ගලයෙකු සිය ජනාධිපති අපේක්ෂකයා ලෙස නම් කරන්නේ නැත.

අවුරුදු පහක් විපක්ෂයේ සිටි මහින්ද රාජපක්ෂ ජනතාවට දුන් පණිවිඩය නම්, ඔහුගේ සහෝදරයෙකු ජනාධිපති විය යුතු බවත්, ඔහුම අගමැති විය යුතු බවත්, තවත් සහෝදරයෙක් කථානායක විය යුතු බවත්, සිව්වන සහෝදරයා ආර්ථිකය භාරව සිටින බවත්, ඔහුගේ පුතා ඔහු තෝරාගත් අනුප්‍රාප්තිකයා ලෙස අප දැනගත යුතු බවයි. එනම් මහින්ද රාජපක්ෂගේ සිහින තුළ ඇත්තේ ශ්‍රී ලංකාවත්, එහි භූමියත් ජනතාවත් රාජ්‍යපක්ෂ පවුලේ බූදලයක් බවය.

අවාසනාවට අපේ රටේ ආගමික හා ජනවාර්ගික සුළුතරයට වෛර කරන යම් පිරිසක් මේ අටේ ජීවත් වේ. ඔවුනට රාජපක්ෂ පවුලේ චින්තනය ආකර්ශනීය වී ඇත. දෙමළ, මුස්ලිම්, කිතුනුවන් සහ වෙනත් අයට තෙවන පන්තියේ පුරවැසියන් ලෙස ජීවත් වීමට බල කෙරෙන තාක් කල් ඔවුන් රාජපක්ෂ පවුල් රාජවංශයක දෙවන පන්තියේ පුරවැසියන් වනු ඇත. අනෙක් පිරිසට හුදු කෑදරකම හා අතීත පාපයන්ගෙන් ගැලවී සිටීමට රාජපක්ෂ පිහිටවනු ඇත.

හුදු මැතිවරණ දෘෂ්ටි කෝණයකින් බලන කල, ජනාධිපති අපේක්ෂක රාජපක්ෂ අපේක්ෂකයා කවුරුන්ද යන්න කිසි විටෙකත් වැදගත් නොවීය. ගෝඨාභය රාජපක්ෂ ජනාධිපති අපේක්ෂකයා ලෙස නම් කිරීම ගැන මට ඇති මතය එයයි. පුරවැසියෙකු ලෙස මට ලැජ්ජා හිතෙන්නේ ඉතිහාසයේ ප්‍රථම වරට ජනාධිපතිවරණයේ ප්‍රධාන තරඟකරුවෙකු ලෙස කටයුතු කරන්නේ අපරාධකරුවෙකු බව පිළිගැනීමට සිදුවීමයි. ඒ පිිළිබඳව මගේ රට වෙනුවෙන් මම පෞද්ගලිකව ලැජ්ජා වෙමි. දිගින් දිගටම අපේක්ෂකයා කවුද යන්න ඇසීමේදී කිසිවෙකු “රාජපක්ෂ පවුලේ කෙනෙක් එයිද?” යන ප්‍රශ්ණය වෙනුවට කවුරුත් ඇසුවේ “මොන රාජපක්ෂද?” යන ප්‍රශ්ණයයි.

සත්‍යය කිව යුතුය. මුළු රාජපක්ෂ වරිගයම නියෝජනය කරන්නේ මැරබලය, දූෂණය, රැවටීම, ප්‍රජාතන්ත්‍ර විරෝධී අදහස් මෙන්ම ස්වාධීන ආයතන කෙරෙහි රොද බැඳගත් වෛරයකි. එහි අපේක්ෂකයා යනු නිකම්ම රූප කායකි. ගෝඨාභය තෝරාගැනීම යනු අළුතින් ඡන්ද එක්කර ගැනීම ගැන ඇතිවූ උද්වේගයක් නොවේ. ඇත්ත යථාර්ථය නම් එවැනි තෝරාගැනීමක් තුළින් ලිබරල් ඡන්ද හා සුළු ජාතික ඡන්ද තවතවත් දුරස්වේ. නමුත් ''ටර්මිනේර්'' කෙනෙකු තෝරාගෙන ඇත්තේ සුවිශේෂී වැඩකටය. මාධ්‍යවේදීන්, පොලිස් නිලධාරීන්, විනිසුරුවරුන් සහ රජයේ සේවකයන්ට සරල පණිවුඩයක් දීමටය. එනම් අපට හරස් කැපුවහොත් අවසානය අතලඟ බව කීමටය.

එය බලාපොරොත්තු සුන්වූ අයෙකු යොදන උපක්‍රමයකි. එය පරාද වී යනු ඇත. දේශපාලනය යනු මැරතන් තරඟයකි. මීටර් සීයකින් තරඟය අවසන් නොවේ. ගමහරහා දුවන විට ඉදිරියෙන්ම පළමුව දිවයන්නා ඉක්මනින් විසිවී යයි. ආධුනිකයෝ එලෙස ඉදිරියටම දිව එයි. මැතිවරණයට මාස කීපයක් තිබියදී මහින්ද රාජපක්ෂ සිය ප්‍රමුඛකතා මොනවාද, සිය හැකියාවන් මොනවාද, ඔහුගේ පාක්ෂිකයන් කවුද යන්න ඇසුවහොත් ඒවාට පිළිතුරු ලබා දී තිබේ. එනම් පළමුවත් දෙවනුවත් තෙවනුවත් රාජපක්ෂ පමණි යන්නයි.

මේ රටේ මීළඟ ජනාධිපති වන්නේ ගෝඨාභය රාජපක්ෂ හෝ වෙනයම් රාජපක්ෂ කෙනෙකු නොවේ. මේ රටේ මීළඟ ජනාධිපති වන්නේ දෑතේ ලේ තවරාගත් අනන්ත මාධ්‍යවේදීන් වධ බන්ධනයට ලක් කළ අපරාධ චෝදනා ඇති අයෙක් නොවේ. අපේ රටේ මීළඟ ජනාධිපති වන්නේ මේ රටේ ඉපදී මේ රටේ හැදී වැඩී මේ රට අතහැර නොගොස් මෙහිම ජීවත් වූ, තවත් රටකට පක්ෂපාතී බවට දිවුරුම් නොදුන් අයෙකි. මීළඟ රටේ ජනාධිපතිවරයා වන්නේ එක්සත් ජාතික පක්ෂයේ හා අනුබද්ධ පක්ෂ විසින් ප්‍රජාතන්ත්‍රවාදීව තෝරාගන්නා අයෙකි. ඔහු ප්‍රජාතන්ත්‍රවාදය වෙනුවෙන් පෙනී සිටින, අධිකරණයේ ස්වාධීනත්වය සුරකින, රජයේ සේවයකයන්ට ගරු කරන කිසිදු පවුලකට ඉහළන් රටේ පුරවැසියා ඔසවා තබන්නෙකි. අපේ පක්ෂයේ අපේක්ෂකයා රටේ ඊළඟ ජනාධිපතිවරයා වනු ඇත.

අපේ අපේක්ෂකයා කවුද?

අපේ රට පුරා විනිවිදභාවය, නිදහස, මානව හිමිකම් සුරක්ෂිත කරන, එසේම ලිබරල් ප්‍රජාතන්ත්‍රවාදයේ බලවේගයන් එක්සත් කරන, ඕනෑම රාජපක්ෂවරයෙකුට හෝ ඔවුන්ගේ සුදු වෑන්වලට එරෙහිව නැගී සිටින, ඒකාධිපති මර්දන හස්තයේ කුරිරු පීඩනයට එරෙහිව ශ්‍රී ලංකා ජනතාව පෙළ ගස්වන ඔහු... නිසැක ජයග්‍රාහකයා වනු ඇත.

Gotabaya Rajapakshe has already been nominated by the Sri Lanka Podujana Peramuna as their presidential candidate. Sri Lanka is on the verge of becoming a fascist nation run by a military junta, however elected through democratic means, akin to the machanism used by Hitler to seize power in Germany.

25 years is a very long time. When you were entrusted with the mantle of UNP leader, I had just finished advanced level examination. Over the years, we watched the UNP lose election after election. We watched you importing presidential candidates and erode the solid block vote we once bragged about. Now the UNP is merely a pauper, at the mercy of minorities. This is the reality. This is your legacy.

It is not surprising that nobody is proposing you to be the presidential candidate as the result would be a foregone conclusion. The bond scam and allowing Arjun Mahendran to escape unscathed has destroyed your reputation. The letter from Lasantha Wickrsmsthunga’s daughter where she accuses you of inaction against the Rajapakshas was the final nail in the coffin. The general consensus is that you have reached a deal with Gotabaya to ensure your status as the leader of the opposition after the election. However, this assurance is not extended to the average UNPers who stand to get beaten up, have their houses torched and lose jobs following defeat at the election.

Take a moment to ponder the fate of these people. There is only one thing between victory and defeat at the election. That is you and only you.

We can still win this election but we should adopt the following winning formula
1)Karu Jayasooriya should be named the presidential candidate.

2)Sajith Premadasa should be named the prime ministerial candidate

3)you may remain the party leader and leader of the alliance to be formed

Karu is the ideal presidential candidate as he is well respected by everyone.
However, the grassroots are yearning for Sajith which makes it pivotal to make him the prime ministerial candidate. This is the magic combination

I hope you will be ready to make this sacrifice for the sake of the party. Karu will have no chance if he nominates you as the prime ministerial candidate as you are politically dead with no resurrection possible.

As the party leader and as the leader of the alliance, you will be expected to play a major role in a future UNP government. This draws parelal to the role played by Sonia Gandhi as the leader of the Congress while Man Mohan Singh was the prime minister.
